i would straight-up hunt this motherfucker down and shoot him down if he had done this to me or any one i love...this is not acceptable behavior....who gave him the idea that this is allowable ?
I live in Onondaga county and the police here are very good. If she would have listened, this wouldn't have happened. shes doing a little something called failure to comply.
Cops can only stop you on probable cause. A probable cause that a felony is being committed, I see no felony being committed in this video. Only the cop is committing a felony. Assault and battery, false arrest, false imprisonment, Grand theft auto, Assault with a deadly weapon, Child endangerment, Slavery, shall I keep going. I see federal charges on this cop
What? He did not need to Taser her. This makes no sense what so ever. Traffic infractions are usually a Petty Misdermeanor and of course he can pull her over.
Actually by law he's not allowed to turn on his red lights unless it's an emergency. The fact that ever cop does means that nobody is calling them on it. Nobody cares these days. They're too busy watching their t.v. and worrying about their new shiney things to educate themselves.
IS this cop, the moronic idiot that he is, still actually carrying a badge? This M-F'er is the one who should be charged ... It's the incredible surplus of idiots like him with tasers, guns, and badges that are responsible for the less-than-tasteful diminutive, "Pig"
She should file a civil action against that cop. File for false imprisonment. Then if he responds to the suit. Put a Motion for Discovery. 1. A complaint filed by the State signed under penalty of perjury and sworn in front of an officer 2. A warrant that was also filed by the state signed under penalty of perjury. 3. Damages suffered by the State signed and sworn to.
4. Evidence of a complaining party. He will not be able to answer it . Because he is acting in his own private capacity.
Are you a sovereign? You know an awful lot about the law and the right way to get things done not to have used that for something good I would suppose.
There are four elements that constitute a crime. And every element must be proven or there is no conviction. So, therefore when the cops stop you. Ask them is it civil or criminal. They can never answer that question. They might say "Its traffic violation". Traffic is operating in commerce for bills or money. And a Violation is a breach of right, an injury. Your not operating in commerce you are traveling and you have immunity under the common law to travel freely without being subject to pigs!
Thank you for this. I say this so much I feel like a broken record sometimes. Are you familiar with Corpus Delecti? Also, it's worth mentioning that in every state constitution it says that in order to be a crime there has to be a victim. If corpus delecti wasn't established they can't charge you with a crime. Too many people don't know that and they will keep getting away with it because they depend on Americans to go along with it as usual.
The STATE is a legal fiction. There is no way a legal fiction can have jurisdiction over a human being. I ususally ask them for the "real party in interest", Federal Rule of Evidence rule 1. How can the state certify the record. When the state is a legal fiction. An attorney can never state a fact before the court. Only the PLaintiff. But the plaintiff does not exist so therefore there is no matter in controversy. I will stand my ground and demand a Plaintiff bring forth the claim!!!
This "hakjason" person is a total asshole. First of all in order for a cop to stop you they have to have probable cause. Probable cause that a crime is being committed or has been committed. 2. Traffic is not a crime. 3. Anytime a police stop you without probable cause they are acting in there own private capacity. 4. They are acting under color of law. 5. You can sue them for assault and battery, harrassment, false imprisonment , false arrest.
You ignorant stupid person! what you wrote makes no sense and is in no way the law. You people trhat say the cop did wrong are making things up, I have watched everything on this horrible situation I could find and the cop clearly states he is pulling her over for speeding.
This lady had no right to demand anything from a police officer, especially while her children were in the car. She should have had the common sence to be a good role model and accept the ticket and fight it in court and win. About the Taser, she retreated back to her van and would not get out of her car and he had to peel her out.
Can you arrest somebody for speeding in that state? And has she no right to refuse the ticket and fight it in court? I've seen another video on youtube where a guy refused it, wanted to go to court but the officer just tasered him. WTF?
not an arrestable offense, and should not be something you taser a mother for because she is upset. But the mother should not refuse commands of a police officer, because they are aholes and unfortunately things like this happen.
Well, that's the thing. You obey an officer, and you stay in your car for your own safety. And you just tell the officer that you will fight it in court, that's it. But why the taser? Are cops just too lazy to use ANY force nowadays for a simple arrest?
This cop did nothing wrong!! She was resisting arrest and he gave her four chances to get back into the car, then she got back into her car and would not get out when he demanded her too. Did this woman actually believe the police have the technology to replay video back to people that commit crimes.
Given the fact that he was behind her the whole time RECORDING the traffic stop leads me to believe that YES they do have the technology, it could have been possibly a bit inconvenient for the officer to go back and replay the thing. We are also not being told the whole story, i.e. what happened before the stop. Unless there is another vid somewhere?
They actually cannot rewind the video for our protection or the corrupt ahole cops would be doing it all the time. We have all seen copslook at the camera after they beat someone when they should not have and you can see the look when they realize they are being recorded.
That's true. Although it is a safe thing to have a video record like that, it would be also great if they had the possibility to rewind the thing (separate device) and show you what you're guilty of like in Europe. I mean as a cop I could make up any story I wanted to and pull somebody over and then charge them with something bogus.
I agree, I just got a speeding ticket the other month from some cop where they were on a bridge with a speeding gun and having some other popo pull me over! wtf
Ahhhh yes, that old routine. Or where they have one trap that you can see and another one down the road where you'd never expect it to be. Love it....
You must be a cop -- defending an idiot like that who tasers a mother in front of her kids -- you call that an idiot worthy of the office of up-holding "the Law" ??? Barely .... You're probably not smart enough to realize that you should be ashamed of yourself -- but -- you should.
What are the four elements that constitute a crime. And if every element cannot be proven there can be no conviction. So therefore hakjason if this women committed a crime then state every element. The only one harmed in this video is the women and her children. Not the cop. This woman should pull a Title 42 lawsuit against this cop and his police department. He is acting under color of law.
I am not sure what four elemnts you are speaking about? The cop could have handled it differently YES but she was not acting rationally. I will be researching these four elemts because I never learned about them in College in any of my law class'?
What world do you people live in?
She did not one thing the officer told her to do. What do you think happens when you don't follow a cops orders? The police have killed for less!
