Cops can only stop you on probable cause. A probable cause that a felony is being committed, I see no felony being committed in this video. Only the cop is committing a felony. Assault and battery, false arrest, false imprisonment, Grand theft auto, Assault with a deadly weapon, Child endangerment, Slavery, shall I keep going. I see federal charges on this cop

She should file a civil action against that cop. File for false imprisonment. Then if he responds to the suit. Put a Motion for Discovery. 1. A complaint filed by the State signed under penalty of perjury and sworn in front of an officer 2. A warrant that was also filed by the state signed under penalty of perjury. 3. Damages suffered by the State signed and sworn to.

4. Evidence of a complaining party. He will not be able to answer it . Because he is acting in his own private capacity.

There are four elements that constitute a crime. And every element must be proven or there is no conviction. So, therefore when the cops stop you. Ask them is it civil or criminal. They can never answer that question. They might say "Its traffic violation". Traffic is operating in commerce for bills or money. And a Violation is a breach of right, an injury. Your not operating in commerce you are traveling and you have immunity under the common law to travel freely without being subject to pigs!

Also, it's worth mentioning that in every state constitution it says that in order to be a crime there has to be a victim. If corpus delecti wasn't established they can't charge you with a crime. Too many people don't know that and they will keep getting away with it because they depend on Americans to go along with it as usual.

The STATE is a legal fiction. There is no way a legal fiction can have jurisdiction over a human being. I ususally ask them for the "real party in interest", Federal Rule of Evidence rule 1. How can the state certify the record. When the state is a legal fiction. An attorney can never state a fact before the court. Only the PLaintiff. But the plaintiff does not exist so therefore there is no matter in controversy. I will stand my ground and demand a Plaintiff bring forth the claim!!!

This lady had no right to demand anything from a police officer, especially while her children were in the car. She should have had the common sence to be a good role model and accept the ticket and fight it in court and win. About the Taser, she retreated back to her van and would not get out of her car and he had to peel her out.

Well, that's the thing. You obey an officer, and you stay in your car for your own safety. And you just tell the officer that you will fight it in court, that's it. But why the taser? Are cops just too lazy to use ANY force nowadays for a simple arrest?

This cop did nothing wrong!! She was resisting arrest and he gave her four chances to get back into the car, then she got back into her car and would not get out when he demanded her too. Did this woman actually believe the police have the technology to replay video back to people that commit crimes.

Given the fact that he was behind her the whole time RECORDING the traffic stop leads me to believe that YES they do have the technology, it could have been possibly a bit inconvenient for the officer to go back and replay the thing. We are also not being told the whole story, i.e. what happened before the stop. Unless there is another vid somewhere?

They actually cannot rewind the video for our protection or the corrupt ahole cops would be doing it all the time. We have all seen copslook at the camera after they beat someone when they should not have and you can see the look when they realize they are being recorded.

Although it is a safe thing to have a video record like that, it would be also great if they had the possibility to rewind the thing (separate device) and show you what you're guilty of like in Europe. I mean as a cop I could make up any story I wanted to and pull somebody over and then charge them with something bogus.
