  • Anymore you can be found guilty of something? It doesn't take much. You have to really tip toe between the laws or else they find you guilty of something. You do one little thing out of protocol and your guilty of breaking the law. Don't motivate cops to look your way. The more time they take to look for something the more shit they can find you guilty of. That's how bad the law is getting. Laws go on the books and they never go off. So many vague laws. So many laws open to interpretation.

  • This is comical. YOU WERE ARRESTED. If you had to post bail YOU WERE ARRESTED. You did violate a law by having something obstructing your windshield. Deal with it. In your other video the dog alerted to your car which gives probably cause for a search. They detained you initially without arresting which they are ALLOWED to do. NONE of your rights have been violated. I agree with standing up for your rights but you DON'T KNOW them. Being detained is not false arrest. Learn your rights.

  • I don't know about NY law, but in PA, it is illegal to have anything(even parking passes) hanging from your rear view mirror in the AS-1 portion of the windshield. Go look at your car. You will see an AS1 or AS-1 with an arrow pointing down from a small dash. Anything that is in that portion of the glass is a violation with the exception of PA state inspection stickers. So, if NY law is the same, sorry to say, they got you. Irony is that police look for air fresheners attempt to mask smoke.

  • i to was pulled over by pa state police for the same thing. the cop came up to my car said license and registration please, and, do you have any crack or bombs in the car, then proceed to search my car and tear it all up, spread my groceries all over the back seat and the floor, then let me go with a warning. what the fuck. all for obstructions in my rear view mirror. ( tree air freshener )?

  • You got arrested for two reasons. One you look like a cross between a troll and a shrubbery, and two cops are basically retarded monkey people with badges.   • first off all, when you cant convey your point without swearing you stultify yourself, and second, the cop had all the reason he needed when the drug dog signaled a hit. its called probable cause. you stated when you talked to the police that you went to law school but you dropped out. i think you should know about probable cause. obviously the hit was true if they did find marijuana in your car. he got the warrant to satisfy you and you were being uncooperative because u insisted on the warrant

  • @Troop66Guide If the stated cause for the stop was 'air fresheners' (which aren't illegal...at least in my state). Anything that happens after that is irrelevant. The dog 'hit' is fruit of the poisonous tree. It should be disregarded via the exclusionary rule. Precedence was set in Silverthorne Lumber Co. v. United States in 1920 and has specific bearing on 4th amendment cases. If the stop was legit then everything after would have been kosher. The stop was not legit. Way to Stand Bundangbear!

  • @ddavis510 First of all, you are assuming this guy is telling the whole truth. Which I doubt since he is was caught breaking the law so he has no credibility. So I doubt he was pulled over solely because he had a couple of air fresheners hanging in his car. Even a cop who was going to lie about the reason for the stop would not say that. Either way, a K-9 "hitting" on a car is enough probable cause to search the car without a warrant.

    Probable cause is when the police have a reasonable suspicion of something illegal, such as seeing the suspect buying drugs or an informant tip. If they don't have anything like that but still want to search (happens all the time) then they have NO PROBABLE CAUSE and can't search without your permission. In those cases they usually ask and they suspect usually says yes because they don't know they have a right to refuse.

  • You were profiled, which you can't prove. Any form of obstuction in your vehicle windows can be used to pull you over. But had it not been that, it would've been something else. At least they can't arrest you for smokin' your herb where you live now. :)

  • I've never broken the law in my life, but I'm scared shit-less when a cop is behind me while driving. I once had two police cars follow me 5 blocks to my house. it was 3am and I went to get a fucking soda and cigs. They followed me and pulled in front of my house after I pulled into my driveway. They sat there as I walked to my front door and opened it. I stared right back at them from my porch until they left. I was defiant, but scared out of my mind and I hate it. Where is my country now? Gone

Then I got another one for quickly turning onto another one-way to avoid an accident. The neglect of the city could have gotten me killed. No signs or markers anywhere. I got no moving violation. All they wanted was money, and the DA basically told me this. He said he didn't care whether I was guilty or not. You pay us this amount, no points on your license.

I went through my security officer training, I have read several law enforcement text books. No real cop would make that correlation. That is a matter of laziness. They see an easy target to make there arrest record look good and thats all. But this backfired on that officer. He spent 6 hours with bear here only to not arrest him (part 1)

  • The stuff hanging from the mirror is kind of dangerous. You can lose traffic while making left turns. They belong on the radio knobs or the shifter. The officer should of told you to take it down and sent you away.

    You should of took them to court. You could have got everything thrown out and a civil case against the officer. What was the total epilougue of this event. Plaese complete the vlog.

For they are one and the same. Is it not true that any person is "innocent until proven guilty in a court of law by a jury of their peers"? I was raised believing that if there was one person I could always trust, it was a police officer. You have made it painfully obvious that those beliefs I once had are false.

  • (continued) Corpus delicti means the body of a crime. Corpus delicti, no matter where you are, always requires at least 2 elements. 1) Violation of an individual right 2) fact of loss, injury, or harm. No corpus delicti = no crime, and the court's jurisdiction isn't invoked. There's no way the sheriff or prosecutor can claim that this man violated their individual rights, so the court must dismiss. The court has no discretion on this issue. He must move to dismiss for lack of corpus delicti.

  • Governments are established to protect and maintain individual rights and for no other reason. Governments establish courts to protect and maintain individual rights. Therefore, you don't need a $100,000 law degree to realize that the only way for a court's jurisdiction to be invoked is if someone's individual rights were violated. We've been led to believe that govmt can criminalize anything they want, but this couldn't be further from the truth. Crimes require corpus delicti.

So, if a policeman wants to arrest a resaurant owner for having salt on his table, would it be combative if the owner protests his arrest? Governments attract people who crave power and control, because gov is their tool to obtain that power. They then pass laws to make everything illegal. Always for our protection. Haha.   • Also a police officer cannot let you take your medication even if it is prescribed to you. The nurse at the jail might be able to if the on call doctor gives her clearance. Even if they called ems they could not do anything other than transport you maybe give you Lomotil if you started shiting yourself. You people watch to much law and order the cop was within his right. He did nothing wrong he stopped you had probable cause to search your car do to a K9 dog hit.

If I was from that part of the country, I would save you the trouble and personally present criminal charges to the grand jury concerning the multiple crimes he committed against you. I would enjoy getting that maggot with a badge indicted. Sadly, going to that county is beyond my means.

  • @bundangbear I'm not clear. Did the sheriff take you to the station? If not, then that was false imprisonment. Also, if he did arrest you and take you directly to the station for booking, instead of immediately taking you to a magistrate as the law requires, changes a lawful arrest into an aggravated kidnapping - another criminal charge for you to present to the grand jury.
