The miranda rights only need to be read when officers interrogate, or ask questions, to the person being arrested.

he did not follow the officers instruction, he was told many times to remove himself from the side walk, he chose to not obay the command, the officer is than obligated to take action over something that could of been avoided, there is no reason for him to be in the area of the police activity, and the officers instructed him to move for his and there own safty, its called crowd control and those officers are responsable for all those people at that scene.

he did not follow the officers instruction, he was told many times to remove himself from the side walk, he chose to not obay the command, the officer is than obligated to take action over something that could of been avoided, there is no reason for him to be in the area of the police activity, and the officers instructed him to move for his and there own safty, its called crowd control and those officers are responsable for all those people at that scene.

@Ecua010 I agree with you, but the officers are required to secure the crime scene, it is their responsability for their saftey, they dont need innocent people in and around the police activity to get hurt, as well as themselves.

@Ecua010 actually it does, what if the SHTF, they are responsable to secure that crime scene so it does not escelate into the general public, cops dont know what they are getting into when they respond to anything, thats why it is importiant for them to remove unnecessary bystanders from the area, anyone including themselves are at risk for potential danger, and yes you are right, cops sometimes over step there boundries and should be held accountable

@wowthatisamazing25 Your rights dont necesserily need to be read to you at your time of "arrest" remeber, just becouse cuffs are applied, doesnt mean you are actually are under arrest, they could just detain you while restrained. However, if you do get prossesed and are chareged with something, then your rights do have to be read to you

@blackopsownerzzz The "maranda rights" are only in a case of iterrogation by the police to obtain information from a person they have in costady. They are read to the person "under arrest" only so he/she knows thier rights before being questioned, it has nothing to do with actually being arrested

@bigmike11214 But it's not illegal or unlawful to simply be on a sidewalk is it? Whether or not the policeman wants him off the sidewalk is a different matter. You can request someone to get off a sidewalk but you cannot order them untill they have broken the law. He wasnt interfering in anyway or doing any harm injury or loss to anyone else. i know a place where it's acceptable to dress bully boys up in uniform and let them give irrational commands to law abiding citizens, nazi germany.

If they question them without being read their rights then they cannot use that in court. Once read their rights, anything they say can be used in court. Learn the law dude. The cops did absolutely nothing wrong. Somebody was arrested for breaking the law, and yes he does not have to be read Miranda unless he under interrogation. I love how all these liberals watch an episode of Law and Order and all the sudden know all the ins and outs of the Criminal Justice system.

for the record i am not a government agent nor a cop by any means.
this video fails to show what was going on between that man and the police, which means that he could have been doing something that would have caused him to be arrested. Futhermore, he doesnt need to be read his rights until they get him back to a squad car for transport.

Let's see, all those people standing in the middle of the sidewalk holding their cellphone camera recording this event can get arrested for Obstructing Pedestrian Traffic, that woman who yelled at the cops can get arrested for Obstructing Government Administration and whoever did not keep walking after hearing the police's order can get arrested for Disorderly Conduct. The cops do not have to tell the crowd what he is being arrested for, they have to tell him. It is none of their business. They we're warned to walk away, they we're looking for trouble. Sure, it's a public street, however maybe, just maybe there was a REASON the officers asked them to keep moving. No i am not a cop, but yes, i would have gladly given her my badge number. I really think people have no common sense sometimes..He did his job, but you want to report him? What a joke.
