For example, contrast the total war battle of Leningrad where over a million civilians were killed vs the Battle of the Alamo where the Black Flag was given yet women children and Negros were spared.
As for sides generally losing if they attack civilians nothing could be further from the truth. Attacking civilians has been a successful strategy of war for thousands of years.
The Black Flag refers to war, war without limitation. Essentially, kill or be killed, and that applies to all on the opposing side: women, children; destroy all possessions and property.
I believe the historical reference originates from the Jolly Roger, flown by pirates upon occasion.

He was a devout christian who viewed the invasion of the south as an evil betrayal. You could study him your whole life and barely know the man.
@Ciorexxx The Black Flag when displayed in battle means that the unit flying it will give no quarter (i.e. no POW's taken) to the enemy and generally will not seek quarter themselves but will fight to the death. I imagine anyone flying the black flag would not be received well by the other side anyway even if they did try to surrender after flying it.
