There was never an iota of evidence that Ninoy was a communist. He was tried under a military court where he was judged by generals who were naturally loyal to their commander in chief (Marcos). They were later on declared vois by Chief Justice Teehankee. A military court has no jurisdiction to try a civilian. Its jurisdiction is only to try offenses committed my members of the military. The rules observed there are not similar to those followed in civil courts.

He declared Martial law so he can perpetuate himself in power. He's supposed to step down in 1973 after serving 2 terms under the 1935 Constitution. In 1973, he caused the abolition of the 1935 Constitution and adopted his 1973 Constitution. The latter charter was not ratified in a popular plebiscite as required by law. The communist scare is an old line used by Marcos. Its the same propaganda spiel he used during the Presidential campaign of 1986 that if Cory wins the communist will take over the country because Cory is a communist.
