If HK made a version that was semi-auto with a 16" barrel, it could be sold to anyone. The 4.6mm round lost in a NATO competition to replace/supplement the 9x19mm to FN Herstal's 5.7x28mm round. The Germans got butthurt and blocked 5.7mm adoption. It's sad, this weapon chambered in 5.7x28mm would be awesome.

The 5.7x28mm FN is sold in the US, you just can't buy the armor piercing variants if you're a civilian. It's more effective than 4.6x30mm HK against armored and unarmored targets. FMJ variants of 4.6x30mm HK are sold in the US, but I have no idea why people buy them. Perhaps they're hoping against hope for the USC?
