  • The Waboba is fun, that much is true, but it is very painful when you get accidentally hit by it. Plus it's very difficult to control.

Waboba was the first one to find the right material for a water boucing ball, and market it right. I would say it is the first ball that can bounce on water, thats available and sold to the public. Yes their advertising is misleading in a way, but its marketing - they want to sell their product. Thats marketing - you see it on tv all the time.

    Don't you see it? You can throw the waboba ball at a good 45 degrees straight into the water, and it would surely jump and skip. That doesn't happen with normal balls. Let alone a cheap plastic ball with nothing but air in it. Know what happens when it hits the water? It pretty much just pads down and stays there. You'd have to throw pretty hard and pretty linear to the water surface to even get a single skip on the water. The waboba you know, skips more...

    That is what is misleading in the advertising. The deliberate attempt to leave the impression in the public mind that it is unique in this ability and profit from this deception.

    If their advertising suggested "skips better on water than other balls" then that would be fine.

    If they have been granted a patent on the ability it is a sad indictment of the patent office competence and prior art knowledge.

"Balls at the RIGHT speed" will bounce, yes true but the point about this product is that BECAUSE of the patent pending design you seem to vehemently trying to invalidate it can be thrown at a wider range and speeds than would normally work. They do not suggest otherwise.
