There's NEVER only one person at fault in a crash (unless you're on your own of course). Part of it was the motorcycle's speed yes, but if the van driver had looked far enough down the road in the first place, the whole thing could have been avoided. They're BOTH to blame.
Given the look of the road, as well as the comparrison of the other vehicles speed, it's quite obvious that the bike in question was speeding. Sure, we don't know the speed limit... there MAY NOT EVEN BE ONE. Either way, it still doesn't matter. IF there was no speed limit, you still assume responsibility of risk by travelling at a high rate of speed. Your actions, your responsibility. Maybe the bike flew around a blind corner. Props to the van driver for stopping in time and not creaming him.

This was the bikers fault, I ride my CBR600 all the time and sticking to the speed limit I have plenty of time to slow down or stop if someone were to pull out in front of me! :)
The driver of that van needs to get driving lessons , one of the first things you learn when driving is to stay on your own lane, with the wheels just pointing to the front until the traffic from the opposite has passed, instead of being half on the other lane.
Bytheway, in order to take the turn, the motorcycle driver needs to lean in towards the left. Because of the leaning there was no way he could have missed the van and stay on the road.

Granted most people would have slowed there as it looks like a busy area, just to be sensible but that still doesn't eliminate blame from the van driver for not looking properly.
Been riding for over 30 + yrs. Best way to put it is even when it is the cars fault technically, the rider is the one that gets taken out. Just like jkunz27 said, it is us as riders that have to take responsibility in assuming that car drivers don't see us. We need to recognize danger before it unfolds in front of us and take the apropriate action to avoid it. Of course it sometimes is easier said then done.
Probably all of the people standing around filming... i dont know what for. It Puts people off as theyre more interested in whats being filmed. That said the bike was going way too fast and luckily he pulled around that van because if he had hit that he'd be a dead man.
OK, So the biker is going some, But, Even at half the speed, The van crossed into the opposing lane with the biker well in sight, I`ve seen another video of the same incident, And you can see into the drivers windscreen, And he`s looking into the the area where the camera is situated, Only at the point of putting the van into the opposing lane does he finally turn his fucking neck to look up the road, Oddly, the biker at a lower speed, May well of crunched into the front of the van

Actually it's the motorcycle's rider's fault. He had enough time to turn or stop, but due to his excessive speed, he was not able to do so. This is not a racing arena... this is a road. And when people ride their motorcycles like that, they cause accidents.

Its bikers responsibility 2 determine when & when not to go all out & that wasnt the time The van however I believe was paying more attention 2 the crowd on the side of the road & not oncoming traffic as he wanted 2 turn without running over stupid people blocking his way. The ppl needed 2 stay back farther from the road & not block traffic trying 2 turn.

I have been a sportbike rider since they first came out, (I had the first Ninja in 1984) but this is clearly the SQUID's fault! He was going so fast that he was probably not even in the van driver's line of vision when he determined it was clear to make his left turn. Bottom line is... It is a motorcycle rider's duty to assume that every other driver on the road does not see him,

Legally the van driver is at fault for failure to yeild right of way...however, the motorcycle driver is liable for "speed greater than reasonable prudence" if he were speeding (I dont see a speed limit sign) and careless and reckless/ negligent driving and "speed contributing" so they both would be up shit creek...but the bike rider def. got the shit end of the stick.
Problem is the van driver hasn't much time to react, whenever I see a vehicle about to turn I do the S. I. A. M. Technique, bikes are little spots to car drivers until the last 25 yards, if the biker was going slower this wouldn't have happened but if the van driver had paid more attention it wouldn't have happened, completely avoidable

The camera doesnt show what the driver was looking at, but I am sure with the curvy road behind, the bike came out fast on a turn. One thing about bike: speed should be such that you will be able to stop before hitting obstacle like suddenly stopped in emergency car. Most probably: if van driver saw bike, distance was sufficient for him to make turn PROVIDED the speed of bike is normal, not exceeding speed limit. Sorry, mine is just attitude of car driver most often seeing bikers violating rules of the road, and endangering others. Many bikers are great people that hate reckless bikers too.
That guy on the bike is an idiot not the van a speeding motorcycle can be as deadly as a speeding car if you are willing to take a chance and probably go over 2 or three times the speed limit on a curvy busy road dont be surprised when in an instant your facing off with life or death
Looks like a country road so even if the van wasnt there, the biker is being an idiot speeding since there is a possibility a wild animal will run out infront of him. At that speed if he swerves he will likely lose control of the bike (hence the accident we have just witnessed in the video.) You also cant see behind the camera incase there is a sudden bend there which blocks the vans vision of oncoming traffic. Without any other visual support on the matter, the fault is solely the bikers.

Bikes are smaller therefore not as clearly seen until closer. 1st rule of defensive driving is always assume every other idiot on the road is out to get you. Speeding biker is 100% asking for trouble in my opinion.
if the biker was going at the normal safe speed the van wouldnt be in the way, the van shouldnt have started turning till that speeder got by, they are both at fault in my mind, they are both idiots
Within 3 seconds of the van starting his turn the bike had crashed, the driver of the van was obviously using his peripheral vision when he was making the turn and did not look directly down the road and check. The guy on the bike may have been speeding but that does not play a factor in this at all, the van driver did not clear the road before turning and in turn possibly cost a man his life.
Van is at fault, PERIOD. Who ever said it's the bike's fault is an oxygen thieving tool. I suspect that if the van had pulled in front of an 18 wheeler you'd be blaming the van. He was going quick but I don't think it was too fast. He managed to avoid the blind van driver. If a truck had come into frame at the same rate it wouldn't look anywhere near as fast. But then again, I guess the van driver would have seen a truck.

@gixuu : the marking on the street is not continual, so he was very well allowed to turn left. The original whole video showed that there were a lot of bikes speeding and racing, and a few seconds before another biker almost had an accident while passing a car in a curve.

Acceleration before an accident is a common way to avoid the accident all together. Probably what the bike did but neither of us know because we weren't there.

I speed too from time to time, but that sure as hell doesn´t give people the right to call/eat/getdressed/shit in their car while totally ignoring their surroundings, I come cross at least 10 assholes like this a day. Every biker knows the dangers since we´ve all gone down (or probably will go down one day, harsh truth) whereas car drivers think they're in a magical safety bubble, in which they can do whatever they want.

@Synetearis If you can´t make assumptions on someone´s speed/speed of an object honestly you shouldn't be driving. The place at which this accident occured seems to have been in an open area, so the driver of the van should've seen the motorcyclist coming from a-far. Even if he could not correctly judge the motorcyclists speed, he should've waited instead till he/she had passed, to then make the turn.
I agree with you yes, but like I said, if the driver of that motorcycle wasnt traveling at that speed this would not have happend. fact... Lower speed means bigger margins to maintain control in situations like this, thats why we have speed limits.

Now obviously the motorcyclist was speeding (judging by the video I'd assume around 140km/h~), but would the driver of the van have turned if it were to be a car instead of a motorcyclist? I highly doubt it. The driver of the van made a bad judgement call.

Speed limits aren't in no way correct guidelines for motorcycles, simply as if motorcyclists were to drive the exact same speed as all the other traffic, (s)he would be overlooked within seconds/minutes by other traffic, the safest speed for a motorcyclist is above that of the general traffic, now many will probably disagree with this, but it is my experience, as well as that of others.
@LithCS And i'll gladly pay whatever speeding ticket comes my way, because I rather pay fines cause of some out of touch politicians than to have to pick my ass off the ground, as well as my bike, due to some old grandpa/ma overlooking me (which happens on a regular basis already).

@ofir2008 The bike was clearly going say 70 - 90 mph. That's 30 to 40 metres per second. It takes 1.5 to 2 seconds between when the van commits to turning (i.e. eyes on apex rather than oncoming traffic) and when the bike arrives. That would mean the bike was 45 to 80 metres away from the van when he commited to turning. Do bike riders really expect every driver to be as focused as them? Van driving isn't exactly adrenaline fuelled, and you need to factor people's flaws into how you drive.

Uh, very misleading title - this crash was NOT the result of the motorcycle speeding but rather the illegal maneuver by the driver of the van. The driver of the VAN was fined and cited for reckless driving, which is correct. All of these "variables" being brought up [could it be a blind curve, if the motorcycle wasn't going so fast, etc.] is irrelevant. Educate yourself - learn the laws of the state you reside in.

I can't believe that some people blames the biker. He wasn't off-speed limits, was on HIS line and had an accident because of the van's driver. Illegal U-turn , turns over solid lines and non-respect of right-priority are my nightmare in France (undisciplined drivers....).

OK, So the biker is going some, But, Even at half the speed, The van crossed into the opposing lane with the biker well in sight, I`ve seen another video of the same incident, And you can see into the drivers windscreen, And he`s looking into the the area where the camera is situated, Only at the point of putting the van into the opposing lane does he finally turn his fucking neck to look up the road, Oddly, the biker at a lower speed, May well of crunched into the front of the van

Actually it's the motorcycle's rider's fault. He had enough time to turn or stop, but due to his excessive speed, he was not able to do so. This is not a racing arena... this is a road. And when people ride their motorcycles like that, they cause accidents.

I think it's safe to say the rider and van are both at fault. Van driver wasnt expecting a bike to come flying round, rider wasnt expecting a van to pull out on him. Just one of those things.

@testdirver The stupid one was on the bike. The van stopped before the riders path was crossed, but he failed to recover. The rider was traveling at far above the posted speed, and froze on the bike. He got what he deserved, I hope, by that I mean to say, I hope the motorcyclist died.

Its bikers responsibility 2 determine when & when not to go all out & that wasnt the time The van however I believe was paying more attention 2 the crowd on the side of the road & not oncoming traffic as he wanted 2 turn without running over stupid people blocking his way. I guess this argument will never be solved seeing as how even the video's title and description defy each other! I have been a sportbike rider since they first came out, (I had the first Ninja in 1984) but this is clearly the SQUID's fault! He was going so fast that he was probably not even in the van driver's line of vision when he determined it was clear to make his left turn. Bottom line is... It is a motorcycle rider's duty to assume that every other driver on the road does not see him,

Legally the van driver is at fault for failure to yeild right of way...however, the motorcycle driver is liable for "speed greater than reasonable prudence" if he were speeding (I dont see a speed limit sign) and careless and reckless/ negligent driving and "speed contributing" so they both would be up shit creek...but the bike rider def. got the shit end of the stick.

Problem is the van driver hasn't much time to react, whenever I see a vehicle about to turn I do the S. I. A. M. Technique, bikes are little spots to car drivers until the last 25 yards, if the biker was going slower this wouldn't have happened but if the van driver had paid more attention it wouldn't have happened, completely avoidable

Its funny when you call the driver who was turning THE IDIOT, when the biker was going FAST! The camera doesnt show what the driver was looking at, but I am sure with the curvy road behind, the bike came out fast on a turn. One thing about bike: speed should be such that you will be able to stop before hitting obstacle like suddenly stopped in emergency car. Most probably: if van driver saw bike, distance was sufficient for him to make turn PROVIDED the speed of bike is normal, not exceeding speed limit. Sorry, mine is just attitude of car driver most often seeing bikers violating rules of the road, and endangering others. Many bikers are great people that hate reckless bikers too.

Looks like a country road so even if the van wasnt there, the biker is being an idiot speeding since there is a possibility a wild animal will run out infront of him. At that speed if he swerves he will likely lose control of the bike (hence the accident we have just witnessed in the video.) You also cant see behind the camera incase there is a sudden bend there which blocks the vans vision of oncoming traffic. Without any other visual support on the matter, the fault is solely the bikers.

Within 3 seconds of the van starting his turn the bike had crashed, the driver of the van was obviously using his peripheral vision when he was making the turn and did not look directly down the road and check. The guy on the bike may have been speeding but that does not play a factor in this at all, the van driver did not clear the road before turning and in turn possibly cost a man his life.

Van is at fault, PERIOD. Who ever said it's the bike's fault is an oxygen thieving tool. I suspect that if the van had pulled in front of an 18 wheeler you'd be blaming the van. @gixuu : the marking on the street is not continual, so he was very well allowed to turn left. The original whole video showed that there were a lot of bikes speeding and racing, and a few seconds before another biker almost had an accident while passing a car in a curve.

I'm not going to trash you like most of these people do on here. The van clearly created the problem here. The bike did everything he could do to avoid contact with the van. Acceleration before an accident is a common way to avoid the accident all together. Probably what the bike did but neither of us know because we weren't there.

The good news is the bad riders are forced to learn quickly or take a spill when they fail so exposure to other traffic is usually rather minimal. Accidents DO happen, but most of the time the moron just rides off the side of the road.

Every biker knows the dangers since we´ve all gone down (or probably will go down one day, harsh truth) whereas car drivers think they're in a magical safety bubble, in which they can do whatever they want.

@Synetearis If you can´t make assumptions on someone´s speed/speed of an object honestly you shouldn't be driving. The place at which this accident occured seems to have been in an open area, so the driver of the van should've seen the motorcyclist coming from a-far. Even if he could not correctly judge the motorcyclists speed, he should've waited instead till he/she had passed, to then make the turn.

If the driver of the van had not turned, would there have been a problem? No.
The driver of the van is at fault here as he failed to judge the speed of an oncoming vehicle, speed of the motorcycle irrelevant at this point.
Now obviously the motorcyclist was speeding (judging by the video I'd assume around 140km/h~), but would the driver of the van have turned if it were to be a car instead of a motorcyclist? I highly doubt it. The driver of the van made a bad judgement call.

Speed limits aren't in no way correct guidelines for motorcycles, simply as if motorcyclists were to drive the exact same speed as all the other traffic, (s)he would be overlooked within seconds/minutes by other traffic, the safest speed for a motorcyclist is above that of the general traffic, now many will probably disagree with this, but it is my experience, as well as that of others.

@ofir2008 The bike was clearly going say 70 - 90 mph. That's 30 to 40 metres per second. It takes 1.5 to 2 seconds between when the van commits to turning (i.e. eyes on apex rather than oncoming traffic) and when the bike arrives. That would mean the bike was 45 to 80 metres away from the van when he commited to turning. Do bike riders really expect every driver to be as focused as them? Van driving isn't exactly adrenaline fuelled, and you need to factor people's flaws into how you drive.

Uh, very misleading title - this crash was NOT the result of the motorcycle speeding but rather the illegal maneuver by the driver of the van. The driver of the VAN was fined and cited for reckless driving, which is correct. All of these "variables" being brought up [could it be a blind curve, if the motorcycle wasn't going so fast, etc.] is irrelevant. Educate yourself - learn the laws of the state you reside in.

I can't believe that some people blames the biker. He wasn't off-speed limits, was on HIS line and had an accident because of the van's driver. Illegal U-turn , turns over solid lines and non-respect of right-priority are my nightmare in France (undisciplined drivers....).
And even if sometimes i drive over the speed limits, it doesn't give anyone the right to pretend having an excuse for bad driving. Hi from Paris and hoping that SOSO will soon be OK.
