Congine should have demanded the cop arrest that guy immediately, or he should have made a citizen's arrest in the presence of the officer and demand the officer take the man into custody and eject him.

Also, Congine should never have let that man near the pole. He should have physically stood in front of the pole so the man could not have accessed it.
