  • @flashtin166 The answer to that is the legal concept of "implied consent." When you sign your drivers license, or apply for your license, then you are consenting to have your breath and/or blood tested for intoxicants. Based on that, you do not have a Fifth Amendment right to refuse a breath or blood test ("implied consent") . P.S. -- Don't shoot the messenger.

  • According to Michigan Dept. of State Police v. Sitz there are guidelines that have to be followed in order for a dui checkpoint to be legal. The supreme court ruled that yes, this is a violation of our 4th amendment rights, but it's ok, because of the state interest in stopping drunk drivers (which is a pretty dangerous precedent, but I digress).

  • You don't need a warrant for checkpoint in California. To stop somebody, you just need to give them something like a pamphlet. If you can smell alcohol when you go to give them a pamphlet you can send them to do a FST, and when they fail that they can be arrested. Supreme court ruled it was ok, and then each state made its own decision. Perfectly legal.

  • For the gentleman who believes that a license is required to drive period let alone in California needs to read Article 1 Section 10 of the US Constitution. It says states are not allowed to issue Letters of Marque. A letter of marque is a license. There for no "drivers, business, or other" licenses are permitted to be issued by a state. Please see supremacy clause. Then look at the issuer of the "License" in your wallet. As the government "We the People" need to take back our RIGHTS.

  • First off I would quote the supremacy clause of the US Constitution Article 6 section 2 states that the constitution is first. Then the laws created by congress. After that the state constitution onto state laws and finally local laws. So working our way down from there we have Article 4 of the bill of rights, a congressional law, which tells the elected servants what we (the government) will not tolerate from them. The California constitution under article 1 section 7 also guarantees this.

  • Doesn't matter what you say, the US Supreme court said that DUI Roadblocks are constitutional and unless the US Supreme court makes a law for the US Supreme Court to overturn previous US Supreme court decisions, the law is legal.   • Philipe, the law you were referring to, that the cop kept asking you "what law?" is the Bill of Rights, man! The first 10 amendments to the Constitution for the United States of America! It states in part, that we are free from illegal search and seizure, the need for a warrant, etc. Next time, tell the cop it's not just a law, it's the SUPREME LAW OF THE LAND!....the 4th amendment to the Constitution! And it is superior to whatever some lower court decided in California.

You need a license to drive THEIR vehicle upon the public highways. The license is PERMISSION to perform an act which is normally illegal. Terms: Vehicle, Driving - they are legal terms.

    Traveling on the public highways in a motor carriage does NOT require a license! You've ALL BEEN FOOLED BY CONTRACT!!

  • The scariest thing about this video is the cop at the end who asked you what law said he needs a warrant to search people's cars. He said something like "All I know is what I am doing is legal" He should have said "I don't really know anything. I do not think for myself. All I know is that I have been told that what I am doing is legal. I mean..do you know how many laws there are? (actually they are not "laws" just "rules" & "codes") I cannot understand all that..I just do as I am told

  • What makes it legal is listed under the link. Go armed with the facts next time and ask the right questions as to whether they are doing it by the book. They don't need a warrant, but they need to still do it legally. Otherwise, it's time to get some new precedents from the courts to make California like the 12 states who uphold these checkpoint as unconstitutional.
