The 10th Amendment states, "The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people." The only reference to Habeas Corpus is, "The Privilege of Habeas Corpus shall not be suspended, unless when in cases of rebellion or invasion the public safety may require it." No delegation of power to suspend this writ is stated and not a power of the President's. Any statute blocking this writ is illegal

Is the white house rotting from the inside. Within 10 months the three most public cabinet members Rumsfeld, Rove and now Gonzales have all left. What is going on? Is Bush cleaning house? With Powell, Ashcroft and Wolfowitz gone who is left besides Rice and Cheney? Two controversial top members gone and less than a month before the Iraq report comes out.
