I realise that this response is 11 months late, but the legal position with regard to the Lisbon Treaty, the ECHR and the death penalty is not as you describe.
Protocols 6 & 13 to the ECHR prohibit the death penalty in all circumstances. Even should the EU not join these protocols, the ECHR cannot confer such powers on the EU, only the member states can. Also, the Charter of Fundamental Rights, which has equal status to the Treaties, outlaws the death penalty under article 2.

One reason I voted NO is because of the death penalty provision in the treaty, read the following a short quote from the treaty. This is a part of the Lisbon Treaty (b) Article 2 of Protocol No 6 to the ECHR:
"A State may make provision in its law for the death penalty in respect of acts
committed in time of war or of imminent threat of war; such penalty shall be applied
only in the instances laid down in the law and in accordance with its provisions"
