The problem isn't that he was killed, the problem is Obama completely ignored all of his constitutional rights as an American citizen. Where does his jurisdiction end? Sure this guy was a terrorist, but what's to stop him from having someone who isn't a terrorist killed?... That's the issue here. Give the man his due process, and try him with something.
The U.S. District Court in D.C. is a 10 minute walk from the White House. No effort was undertaken to acquire an arrest warrant or to hold a trial in abstentia. No effort was undertaken to even determine what process is due when arrest is impractical or impossible in a case such as this.
Only a judge and/or jury should be able to adjudicate the legal rights and classifications that will result in the execution of an American citizen.

The CSA was an unrecognized state, and as such, those living on CSA land were still thought, by the Union, to have US citizenship. Were we right in shooting them?

The U.S. District Court in D.C. is a 10 minute walk from the White House. No effort was undertaken to acquire an arrest warrant or to hold a trial in abstentia. No effort was undertaken to even determine what process is due when arrest is impractical or impossible in a case such as this.
Only a judge and/or jury should be able to adjudicate the legal rights and classifications that will result in the execution of an American citizen.

@hellsunicorn Your unfair criticisms of Lincoln aside, to say that we can't kill an enemy leader in an armed conflict, regardless of citizenship, is to deny centuries of precedent. It's impractical, dangerous, and only relevant for guys like Savage whose job it is to be Obama's contrarian. Ask your history professor next time you see him.

@LeaningTowardsPisa What is unfair about bringing up the fact that Lincoln regularly jailed and attempted to deport journalists for speaking their minds, or the fact that New York was literally on fire for days and the streets flowed with blood because the poor rioted for not being able to buy their way out of Lincoln's draft.
P.S. - I learned about these events from my history professor, so try another one. Practical or not, people have rights, learn it and live it.

You jabbered on about New York and anti-government journalists. Please, explain. What should we do with militant citizen leaders, when arrest is impractical?

@LeaningTowardsPisa The answer to your question is that if arrest is never impractical. The life of one citizen takes precedence over the practicality of government power. The Civil War was, by definition, an unjust and ungodly war, and every member of the Union Army was party to mass murder. The minute the Confederacy seceded, the Union troops became foreign occupiers, ergo imperial forces. Empires are, by nature, unjust.

An arrest wasn't impractical at all. Al-Awlaki wasn't killed on the battlefield, that's not what happened like you stupid liberal Obama bots believe.
The Fort Hood shooter terrorist Nidal Malik Hasan who actually shot and killed people was given a trial.
Al-Awlaki on the other hand was simply executed by the order of the President without any due process (not killed on the battlefield).

@goofeykid19 If you'll notice, I specifically stated that it was relevant because we shot at an killed US Citizens. Confederate soldiers, in the eyes of our government, were US Citizens. Why is that justifiable? Because they're enemy combatants. Why is killing al-Awlaki justifiable? Because he's an enemy combatant. There's the parallel.

However Awlaki inspite of being an American Citizen was a member of Al Qaeda and war was declared on Al Qaeda. Could he have still been put on trial? Yes but since he was Al Qaeda, dead or alive it would be constitutional.

@kingcobra101z You could, but you'd be wrong. Lincoln, and every other Union leader, saw Confederates as US Citizens. By what other measure would the Emancipation Proclamation make any sense, freeing slaves in the "states in rebellion". That'd be like Lincoln freeing all the slaves in Nairobi if the CSA were seen as just another state. But it wasn't.

Jefferson wrote: "The Constitution has made no provision for our holding foreign territory, still less of incorporating foreign nations into our Union." Yet, Jefferson secured the purchase of the Louisiana territory anyway. Under Monroe, we invaded and captured Florida from Spain without congressional approval..

@Deist1965 Jefferson was referring to a "citizen" and not the government. We are in an undeclared (hence illegal) war on a tactic - terrorism. People question Ron Paul as a Commander in chief? He seems to make the right statement on the spot even when most people even bright people like Savage discover it later. Where in the constitution does it say enemy combatants are entitled to constitutional protections? Well - if they happen to be American...see the 14th amendment.
