Cheers for Ms. Goode and those supporting her. Had the police harassment victim been white, we would never have heard of this incident. Whites have become so cowardly in the face of authority I wonder how they ever gained the freedom they have as Americans. Yes, police do unfairly arrest, beat, and even kill whites too--such as the murder of Kelly Thomas in LA, among the many--and get away with little if any punishment.
The LEO does not have a private space as a PUBLIC official. There is NO SUCH thing as privacy in the public.
What LAWFUL authority did the LEO have to make the ORDER to begin with. Want of jurisdiction does not create law. NO LEO that can bring a charge without a SWORN affidavit. Prove the warrant was signed or dismiss with prejudice.
@bankypunk, To be in the officers space, she would have had to go up to the officer and record him and the scene. She was clearly not in their space, and to be exact, the officer went into her yard and arrested her. Rights were violated. Going on her property and arresting her with false accusations. If they were to try that, I'd go inside and lock the door. If they were to break the door down to get in, then a huge lawsuit will be coming. They can't make their own rules.
Not only does the first amendment allow us to do so, but it is also IMPLIED by the 4th amendment, particularly, the clause regarding "the right of the people to be secure in their persons, papers, houses, and effects..." implicitly stating we can do what we see fit to maintain our sense of security.
Don't be fooled black, brown, and yellow people. Racism is alive today as it was in 1865. Don't be fooled by white people LYING to you about racism is "a thing of the past". They use that propaganda just to defeat your logic when cases like this arise in the media. If everyone agreed racism was non-existent, then how do you challenge a racist cop who beat and murdered your loved ones? Racism is not going anywhere anytime soon. White people need racist policies for their own survival.
@mikedav9O What a fucking joke ! The most racist people out there arent white !! If a white guy said half the shit as what a black guy says in music there would be every black activist knocking on the govt door to get it stopped but a black rapper can say what ever he wants about white women/man and its ok !! So go take your blame and go find someone else to cry to !!
Your discussion has nothing to do with my previous statement. I never addressed the issue about who or what was the most racist. If you can find where I did, please present it now. You have a simple case of "dyslexia". Go get help with that and then press the response button.
@mikedav9O Are you really that fucking stupid? Read YOUR comment asshat !! "dont be fooled black brown and yellow people" "white people need racist policies for their own survival" So if that doesnt imply that white people are the ones who are still racist like in "1865" !!! So no case of dyslexia you stupid fuck just a case of you are an idiot and probly the guy that blames having a shitty job and no money on the man for keeping you down !! loser
You still have not show me where I have stated "[[who or what]] was most racist". A good history book can quickly confirm that white people have established racist policies. If you do not understand how to use an encyclopedia, try using google to search for "Black Codes", "slave codes", and/ or "Jim Crow" laws. These racist policies were not created by blacks but were created by WHITE PEOPLE. It's about time you take a look in the mirror, white boy.
@mikedav9O So yes you really are that fucking stupid ! You just stated again that its white people who are racist and again read what i said before !! So if white people created these policies to survive you are saying that blacks are to stupid to do anything about it ? Who's the racist again i would say it would be you against white people ! So you should go take a look in the mirror negro .......
Again, show me verbatim where exactly I stated [["white people are racist"]]. You have a reading disorder. I stated white people did in fact create racist laws to specifically hinder blacks, such as: Black Code Laws; Slave Code Laws, and Jim Crow. Prove anything I have said about those policies being fabricated. You can't! Once, again, look in the mirror, white boy. Those white people who created those laws look like you. So, don't get on here tooting your horn against the FACTS!
@mikedav9O Fact you are a racist ! Boo hoo were you ever enslaved? Nope so quit crying about shit you had no part of or personally suffered anything so go find a job instead of being a drain on society and blaming it on history !! FACT Over and out
Another fact, you're just as racist as your ancestors who created racist laws that targeted Blacks, Chinese, and Native Americans, You belong to the most hated race in the world. Your white race is ranked very low on the morality gauge that if North Korea, China, or Russia invade the USA, I and 10s of millions of other American minority groups (Blacks, Mexican Americans, Arab Americans, etc),would not assist your racist white ass in "defending" our borders.Fight your own war, whitey
@mikedav9O Whites are the least racist, otherwise those you mentioned would be living their nasty and brutish lives without benefit of the longer and better lives science has wrought. Blacks, Mexican Americans, and Arabs treat each other far worse than whites treat them. Whites are welcome in other races' countries only for exploitation and receive deplorable treatment from such hosts. Think before scribbling such racist nonsense. One with your hostility will always stir trouble.
Son, stop trying to promote your race. You sound like a broken record-player of deceit. Everybody on the earth knows white people are the most hated, pathetic and evil race to ever exist. For you to try to persuade me to the contrary is merely a waste of your time. If you want to promote a product, do what everyone else does and pay the necessary fee for a commercial. If you are not willing to pay, then it shows how much you believe the smoke you're blowing from your ass
@mikedav9O So here you are, a silly and ungrateful jackass racist writing the English you learned from white people, on a computer, under electric lights, after using your flush toilet, gas stove--and probably in housing subsidized by white taxpayers, being protected safely from your fellows by white policemen, in a country governed by a half-black President elected by white people. You pitifully jealous tiny racist person! What have you created but hatred? Stay in school.
Wow! Its really amazing to actually see that someone caught a policeman pulling such an blatant injustice to its citizens. It really irks me to the core that police and law enforcement have obviously forgotten their first job which is to protect and serve its citizens.
The judge dismissed the case after seeing the evidence. But the damage has already been done. The comments from Mike Mazzeo of the Police Locust Club show that the police feel their actions are justified. This officer was somehow scared of an unarmed white woman holding a camera in her hand and video taping their actions. "The officer had the perception he was unsafe." So arrests like this may continue by police officers who don't want to be video taped in public.
@babypunk I've served in the military and I generally respect people in uniform. I try to give them a wide berth. I'm from Rochester, N.Y. However, the RPD officer that is talking is the video is an asshole. He's the kind of guy who would get his ass kicked if he were on shore leave!
@woodhavenblvd. I've served in the military and I generally respect people in uniform. I try to give them a wide berth. I'm from Rochester, N.Y. However, the RPD officer that is talking is the video is an asshole. He's the kind of guy who would get his ass kicked if he were on shore leave!
@bankypunk - A better question might be what rights DIDN'T he violate but I will indulge you
let's see....
She was videotaping something that was happening in public when the officer denied her ability to do that - 1st amendment
She was on her own property when the officer approached/arrested/searched her and seized her property without probable cause or a warrant - 4th amendment
She has a very good case to sue the officer and department and she will win - I hope she does it.
Her arrest had nothing to do with videotaping and had everything to do with the fact that she was invading the space of the officer's while they were doing their job. It's an officer safety issue. Videotaping things does not give you immunity from the following the rules.
The fact that she was on her own property is immaterial. She was obstructing government administration, so the officers had probable cause to arrest her.
I don't have to prove you wrong, the DA has already said you are wrong.
The LEO's clearly could not show it was a safety issue since the charges were dismissed. Officer Safety has been the battle cry of LEO's everywhere as a catch-all for them to over-control a scene.
Either way they neutralized the threat, and crybabies like you whine about it. If she had stayed on her stoop none of this would have happened. She did this purposely to provoke the officers into acting so she could play victim and scream police brutality. Police officers have a really hard job to do. Yes they should be held to a higher standard, but people should recognize the situations they should stay out of.
The point being that recording a public official should not be considered provocation. The supreme court has ruled that Videotaping public officials is a right protected by the first amendment, something that LEO's especially should respect and enforce.
LEO's need to respect the law as much, if not more so, than anyone else. All of the law, including the constitution.
Cool straw man argument bro. It's clear that she wasn't arrested for video taping, she was arrested for violating the space of the officers and antagonizing them. They had enough to worry about with the guy they had pulled over, they didn't need some random bitch coming at them from behind and running her mouth.
It's clear I am not your bro, nor from the tone of your comments do I want to be.
And it's not clear that she was arrested for that. In my opinion she was not violating the LEO's space nor was the antagonistic and clearly the DA agrees with me on this. Smart DA, he knows the law.
Too bad the LEO's didn't.
Also she was not 'coming at them' - it is clear from the video that she was over 20 feet away and stationary. Clearly there was no threat, perceived or otherwise
She was clearly unarmed and standing a respectful distance from the LEO's so where was the threat? If an LEO is that scared of ANYONE being in proximity to them, then they are in the wrong job and more of a danger to themselves and the public than a criminal.
@bankypunk I do understand it. I also understand that they knew that when they took the job and that a combination of good situational awareness and proper training will minimize that threat.
Threats like what you speak of cannot be eliminated only minimized, but the constitution and the supreme court has made it clear that that minimization cannot come at the expense of the rights guaranteed to us by the constitution.
@bankypunk Actually it's more to do with training, social isolation and indoctrination into the blue code. By their own insular culture cops isolate themselves from the wider community and it quickly becomes "us vrs them".
What rules did she break? Disobeying an LEO? For that to be true it would have to have been a lawful order which it clearly was not. Just because someone is a LEO does not mean they can order you to do anything they want. The order has to be a lawfully justified one, otherwise an LEO could order you to jump off a bridge and then arrest you for not complying even though it would mean your death.
I am a retired LEO. LEO's do NOT have the right to ignore your rights for their own.
Cool story bro. It's easy to claim you're a cop to try and invalidate my argument when you have no way to prove it. Unless you'd be willing to state your name and the department you worked for. All I know is I've taken classes in law of Arrest, Search, and Seizure and based on that education, I see nothing unlawful about the arrest.
I don't have to prove it, you do, however if you'd like I will. As soon as you do the same.
So you've taken 'classes' but are not a lawyer or LEO yet you portray yourself as a knowledgeable person qualified to judge the performance of others in fields that you have never worked or attained a degree in.
So according to your logic, since I have held a knife I am qualified to perform surgery. Wow, I wish someone had let me know that earlier, imagine all the money I could have made.
@bankypunk yep, and that was the day after I jumped in my Delorean and went back in time to help the Beatles write all their classic hits, and while I was there I decided to turn clay into gold because I felt as though the local residents could use some more wealth, wow, making shit up is fun, now I see why you do it!
