  • Cheers for Ms. Goode and those supporting her. Had the police harassment victim been white, we would never have heard of this incident. Whites have become so cowardly in the face of authority I wonder how they ever gained the freedom they have as Americans. Yes, police do unfairly arrest, beat, and even kill whites too--such as the murder of Kelly Thomas in LA, among the many--and get away with little if any punishment.

  • The LEO does not have a private space as a PUBLIC official. There is NO SUCH thing as privacy in the public.

    What LAWFUL authority did the LEO have to make the ORDER to begin with. Want of jurisdiction does not create law. NO LEO that can bring a charge without a SWORN affidavit. Prove the warrant was signed or dismiss with prejudice.

  • @bankypunk, To be in the officers space, she would have had to go up to the officer and record him and the scene. She was clearly not in their space, and to be exact, the officer went into her yard and arrested her. Rights were violated. Going on her property and arresting her with false accusations. If they were to try that, I'd go inside and lock the door. If they were to break the door down to get in, then a huge lawsuit will be coming. They can't make their own rules.

  • Not only does the first amendment allow us to do so, but it is also IMPLIED by the 4th amendment, particularly, the clause regarding "the right of the people to be secure in their persons, papers, houses, and effects..." implicitly stating we can do what we see fit to maintain our sense of security.

    You still have not show me where I have stated "[[who or what]] was most racist". A good history book can quickly confirm that white people have established racist policies. If you do not understand how to use an encyclopedia, try using google to search for "Black Codes", "slave codes", and/ or "Jim Crow" laws. These racist policies were not created by blacks but were created by WHITE PEOPLE. It's about time you take a look in the mirror, white boy.

I stated white people did in fact create racist laws to specifically hinder blacks, such as: Black Code Laws; Slave Code Laws, and Jim Crow.   • The judge dismissed the case after seeing the evidence. But the damage has already been done. The comments from Mike Mazzeo of the Police Locust Club show that the police feel their actions are justified. This officer was somehow scared of an unarmed white woman holding a camera in her hand and video taping their actions. "The officer had the perception he was unsafe." So arrests like this may continue by police officers who don't want to be video taped in public.

  • @woodhavenblvd. I've served in the military and I generally respect people in uniform. I try to give them a wide berth. I'm from Rochester, N.Y. However, the RPD officer that is talking is the video is an asshole. He's the kind of guy who would get his ass kicked if he were on shore leave!

    She was videotaping something that was happening in public when the officer denied her ability to do that - 1st amendment

    She was on her own property when the officer approached/arrested/searched her and seized her property without probable cause or a warrant - 4th amendment

    She has a very good case to sue the officer and department and she will win - I hope she does it.

    Her arrest had nothing to do with videotaping and had everything to do with the fact that she was invading the space of the officer's while they were doing their job. It's an officer safety issue. Videotaping things does not give you immunity from the following the rules.

    The fact that she was on her own property is immaterial. She was obstructing government administration, so the officers had probable cause to arrest her.

    The LEO's clearly could not show it was a safety issue since the charges were dismissed. Officer Safety has been the battle cry of LEO's everywhere as a catch-all for them to over-control a scene.

She did this purposely to provoke the officers into acting so she could play victim and scream police brutality. Police officers have a really hard job to do. Yes they should be held to a higher standard, but people should recognize the situations they should stay out of.

    The point being that recording a public official should not be considered provocation. The supreme court has ruled that Videotaping public officials is a right protected by the first amendment, something that LEO's especially should respect and enforce.

    LEO's need to respect the law as much, if not more so, than anyone else. All of the law, including the constitution.

They had enough to worry about with the guy they had pulled over, they didn't need some random bitch coming at them from behind and running her mouth.

    And it's not clear that she was arrested for that. In my opinion she was not violating the LEO's space nor was the antagonistic and clearly the DA agrees with me on this. Smart DA, he knows the law.

    Also she was not 'coming at them' - it is clear from the video that she was over 20 feet away and stationary. Clearly there was no threat, perceived or otherwise

    She was clearly unarmed and standing a respectful distance from the LEO's so where was the threat? If an LEO is that scared of ANYONE being in proximity to them, then they are in the wrong job and more of a danger to themselves and the public than a criminal.

  • @bankypunk I do understand it. I also understand that they knew that when they took the job and that a combination of good situational awareness and proper training will minimize that threat.

    Threats like what you speak of cannot be eliminated only minimized, but the constitution and the supreme court has made it clear that that minimization cannot come at the expense of the rights guaranteed to us by the constitution.

    What rules did she break? Disobeying an LEO? For that to be true it would have to have been a lawful order which it clearly was not. Just because someone is a LEO does not mean they can order you to do anything they want. The order has to be a lawfully justified one, otherwise an LEO could order you to jump off a bridge and then arrest you for not complying even though it would mean your death.

    I am a retired LEO. LEO's do NOT have the right to ignore your rights for their own.

All I know is I've taken classes in law of Arrest, Search, and Seizure and based on that education, I see nothing unlawful about the arrest.
