I don't see how Ricks prayers meeting is violating anything in the 1st amendment. If he wants to shot himself in the foot by revealing to liberal/moderate Christians that him and conservative Christian are crazy well by all means he should be allowed to. As long as he isn't using his Gov' powers to force people to attend or fund the event with state money I'm fine with it. It's better that people see just how crazy religion is instead of trying to make it taboo.

@miniontemp Gov. Perry acting in his capacity as the Governor, as he states in the video, makes him a state actor. A state actor acting in their offical capacity can be construed as state action. State action must not have a "primary or principle effect" to advance religion (County of Allegheny v. ACLU, 492 US 573) within the 3 prong test of the Lemon Test (Lemon v. Kurtzman, 403 US 602).

@miniontemple that three part test from Lemon are the following:
1. The government's action must have a secular legislative purpose; (fails, no secular purpose here)
2. The government's action must not have the primary effect of either advancing or inhibiting religion; (looks like the pri purpose is to advance Christianity)
3, The government's action must not result in an "excessive government entanglement" with religion. (the gov leading a prayer? Looks like excessive entanglement to me)

@gaiyabum The law forbids government sponsorship or legislation. This is neither. The AFA is holding and funding the event. Just because he is the governor does not forbid him from taking part or being the spokesperson for the event.

@miniontemple As I mentioned before, he's presenting himself in his official capacity, so that would be tantamount to violating the first and second parts of the Lemon Test. This isn't even worth arguing about because any Federal Court should just apply precedent and slap it down like Pippen slamming it down on Ewing circa 1994 NBA playoffs.

@gaiyabum The governor has the right to take part in any event he chooses. He clearly states he understands the limitations he has. The event can not be stopped by the court because it is not government affiliated and is privately funded. This lawsuit is an embarassment for those of us that actually believe in religious freedom.

Governor Perry may do as he pleases vis-a-vis prayer when acting in his personal capacity. However, in his official capacity as governor, he does not enjoy the same degree of liberty. It is inconsistent with the 1st Amendment for government to promote religious doctrine or practice. That is precisely what Perry did by issuing the proclamation in his official capacity.

This is not a law DOESN'T MATTER and is not sponsored by the gov HE POSTED IT ON HIS OFFICIAL GOVERNMENT WEBSITE. In fact the first amendment supports it as it is free exercise NOT WHEN A PRAYER MEETING IS CALLED FOR BY AN ELECTED OFFICIAL ON AN OFFICIAL GOVERNMENT WEBSITE.
If he used his own, personal, non-gov't Facebook page, this might be different, though still at least gray.

I always wonder how it is that Conservatives have a tendency to agree to something they never read.
Like, when they talk about the Amendments, they have to entirely ignore what it says and "agree" with it. Just like how they "agree" with a Bible they haven't read 50% of or any of those things. It's wonderous.
