  • It's not exactly wrong for a woman to take pictures of herself..to keep in her phone, The police had no proof (as far as i know) that she had sent those pictures to anyone so it's not like she was "Promoting" any sexual acts or sexual material, not that the cops could prove at least, and the school screwed it all up for themselves as soon as they went through her phone without permisson anyway. Don't the police need warrants to check personal property anyway?

  • In this case they are liable for invading her privacy and if she really wanted to pursue it she could legally bring a case against the police for opening the phone thats fruit from a poisonis tree the officers had no right to look for the phone and would have had to ask permision to look or obtained a warrent for search .

They had no right to go through her phone or anyones phone, the only time they might be able to legaly go through a phone is if they found a phone and had no idea whos it was and tried to find the owner .

  • there is a few things wrong with what the school did. 1. they had no right to look through her phone. especilly with no probabal cause. 2. since the school was not acting with a warrant it was illegal of THEM so the evidence is technically invalid in court. & 3. from what i have read she was already 18 so it wasn't child porn. she committed no crime.

  • i agree about 90% on this one. it would be 100% if she was infact 18 years old and the pictures in question were of her after she turned 18 or of someone else who was over the age of 18. now with that said. the school had no right to be going through her phone for any reason what so ever. kinda reminds me of a story i heard about which involved a school using remote access to laptops they issued to students and watched the students on webcam undressing and engaging in other activaties.

  • You're right. They had the right to TAKE the phone but they did not have the right to go through it. Policy usually is that if they see the phone it will be confiscated but it's a MAJOR invasion of privacy to go through the phone. Further more IF she were 18 she would be 100% in the clear to have her own nude photos on her phone.

  • Taking away a cell phone while the student is using it in school, I can understand. Taking nude pistures is wrong, I agree on that, but the school had absolutely no right to do that. It violates the constitution, and no company (weather they work for the government of nor) should have the OK to violate the constitution.

  • She shouldn't have been talking on it at school, most school don't allow them on campus. The school should have called a parent, not searched it themselves. She was 18 so if she wants to take pics of herself she has a right to. Unless she had pics of younger kids she shouldn't be accused of underage pornography. She should at least try to sue. For her privacy, the accusations, and the time she took for those classes. With how stupid laws are, she may not win, but she should win, and should try.

  • Our school goes through peoples phones as well, my m8 lets just say he had a few videos of naked women, school took the phone off him for texting in class, teacher looked through and found them. He was in isolation for a week and had the videos deleted. when i got my phone taken off me all the back of my phone was scratched.

And all that business has nothing to with the criminal aspect of this situation, I see no crime here and yet they were trying to make her out to be a sex offender over nothing. The school over-stepped their boundaries, they had every right to take her phone but they had no right to do anything else with it and especially not to get the police involved over a non-crime.

Technically the only way someone can actually just grown through ur stuff is if they have court concent for a reasonable doubt. In this case it was just conficating her cell phone due to using it in class so I am on your side about her privacy being violated

  • She definitely has a case. This is a problem in the school system today. This has NOTHING to do with her education. The school has the right to take a cell phone yes, but no school has the right to violate the privacy of a student. It's not like she was walking around showing others her pictures. They had NO reason to search the young woman's phone, 18 years old or not. I hope she wins and teaches the school something that they obviously don't have in the curriculum.

  • odd situation... while it really was invasion of privacy I'm sure it depends on what the school's/district's rules say as to when and where they are able to check a cell phone if it is confiscated. I'm sure the POINT of it is to check to see if the student was cheating or selling drugs or something, but if they find something else like underage porn then that is free game once they are allowed to search the phone at all.

    unfortunate situation..period.

    The fact of the matter is that there was underage porn (other ppl?), which is illegal. Its just like if someone is pulled over for a broken headlight and it turns out they are drunk, high, and have 100k of stolen munitions in the back.... they are going to arrest you for the other things. Same goes with this.

    The real question here is if the rules DO say they can check... should that rule be changed. There is a reason students sign contracts at the beginning of the year.

  • This is one of those cases when the school dug its down grave. Taking the cell phone is the correct choice, but going through the phone was not. It's her own right to be taking photos of her naked self with her own cellphone. How did the school even know that she sexted? That's like saying a person must have killed someone if he had a knife thats not for cooking.

  • I don't agree with them looking through the phone but my old high school did stuff like that all the time. But another thing is that I think the punishment was all bad. It is wrong that she took nude photos, but she was (?) 18 at the time and you don't know if she sent the photos to anyone. Also, they did not need to involve the police, that was extreme. A talk with the parents or having the counselor talk to the girl about the problems with sexting would have been good enough.

  • my school has a code of conduct that every student and student's parents has to sign at the beginning of the year. It basically takes away any privacy at all and gives the school the right to search whatever they feel like and its ok because the parents and student agreed to it. If the girl's school had something similar then that could be the justification for searching the cell phone but otherwise its probably an invasion of privacy.

  • When I was in high school my phone got taken a couple times but they turn it off in front of you and put a sticker on it with your name then put it up and they make sure that you see where it goes. The teachers are not allowed to take phones and store it themselves, they have to hand it to an administrator. If your phone gets taken 3+ times you cannot pick it up yourself after the school day, your parent or guardian has to pick it up.
