I mean, sure, the artist may EVENTUALLY release them on some Greatest Hits or Unreleased Compilation disc (like Disturbed did with The Lost Children), but would it be bad to "illegally" download a track that was never set to market? I know the answer is probably in some grey area but it's an interesting thought.
