Why is it that medical cannabis cultivators cannot make a profit for there intensive labor and skilled trade? How much did Merck, Pfizer, Novartis, and all these other Narco-Pharma-Robber Barons make off ill people? How many died of complications from hard narcotic drugs( so called "meds") prescribed by doctors who got kick backs? How much money do each of these Narco-Pharma's contribute each year topoliticians? If the DA is for self-cultivation than assit and allow those in need to grow medical quality cannabis. When you start paying for the grow, you will see why these dispensaries may have been raising funds.Overhead costs, time, and skilled labor. Think about it Carpetbagger.

A collective - a loosely defined group of people that are interacting for a similar purpose.

There are several steps to understanding the law;

1)Read CA Health and Safety Code - particulary 113.765 and 775.

2)Read the Ag Guidelines which were writtent primarily to address question of whether big storefronts were legal

3)Read Caselaw - cases that have been appealed up through the supreme courts

4)UNDERSTAND YOU ARE IN SAN DIEGO.

It is true the law can be confusing to some. The law does say give an exemption to sales and all sales related prosecution in several instances related to helping a medical marijuana patient obtain their medicine of choice.

The law does NOT say that it must be a business and that it must be a registered as a NONProfit. Although that would be a smart thing for a person to do if they wantd to help other patients.

But it is being MIS READ.. the law says you can't be charged with THOSE HIGHLIGHTED CRIMES... for running a collective... and that REASONABLE compensation can be given...

I wish that it was as simple as that with our DA. The issue with her is regardless of how the organization is setup, non profit, mutual benefit, salaries, membership agreements, reseller permits, zoning clearances, etc...doesnt matter. As far as our DA is concerned there is NOT provision in the law for sales, under any circumstances.
