I believe the initial reasoning the US Constitution was so vague on war powers was because the writers understood that warfare was changing, a country could be attacked very quickly, so it was necessary to word the "declare war" section vaguely, so the President could command the military in the event of an invasion of US territory, before Congress officially declared war.
I think, in retrospect, it was a mistake, if it was worded strongly the US could have stayed out of Vietnam/Iraq.

Paul; is full of shit, due to the doctrine of the "unilateral presidency" the President DOES NOT NEED congressional approval to take military action, the Constitution's article II powers names him as C-in-C. Should he have to get permission for most every military action from congress? Yes, but that is currently not how the constitution is written or has been interpreted. Goes all the way back to the Prize cases.
@MaiLingDolly I looked it up: "The President shall be Commander in Chief of the Army and Navy of the United States... when called into the actual Service of the United States." That last part can be interpreted as saying that the president needs a formal declaration of war to take military action. Otherwise, the War Powers Resolution of 1973 puts a limit on his authority.
@rmhism That's a good point, the Supreme Court has broadly interpreted Presidential power however in regards to the use of military force. Only in Youngstown Sheet and Tube did the Supreme Court check this his power explicitly. The War Powers resolution is congressional law also, which is not superior to constitutional law, it is inferior to it. A constitutional amendment would be far more effective in checking Presidential use of military power but we'll probably never have that.
I wish that we would elect educated people who truly know what they are talking about. It seems everyone likes the "pretty boys" that can read the teleprompter and have to have 40 advisors tell them what to say on every issue. I don't agree with Ron Paul about many things--but I respect him in moments like these because he's not a politician. He has a set of ideals that he believes in, and when you ask him a question he answers based on those ideals. He does not answer with what would get the most votes.

The most important freedoms are pretty separate from economics (press, religion, speech, etc). Anyway, now I live in a country that has less economic freedom than America, but has a higher standard of living and better health care (I live in Japan), and I like it much better that way.

Doubt what he said was stupid. When Iran, a terrorist state, acquires nuclear weapons they could well help others acquire the technology. This is not a state that has the controls that the United States has, its hostile and keen to bring down its enemies and civilians will be a target. At the moment they are held back by the fact that Israel, a democracy, has nuclear weapons but with a technology as powerful as that they will surely become more brave and Iran is no friend of America.

The only thing in short supply regarding nuclear weapons is the nuclear material itself - and "short supply" is a lose term, since there is actually a lot of it, it's just not easy to get ahold of.

Huge difference between a small dog and a missile even a medium range missile something which the Iranians already have. Guess if you strap the dog to the missile it would possibly work, or if you tie rockets to the back of the pickup. Nuclear material in the wrong hands can never be good and Iran is not exactly the friendliest country. Bad other countries have it.

The 90 day thing is clearly stated in the war powers act. The act was passed to resolve the conflict that your supposedly inerrant document, the constitution, created when it declared the president commander and chief but gave congress the right ton declare war. Prior to that, presidents could deploy armies indefinitely under the guise of "police actions" without congress' approval

What Ron Paul doesn't seem to realize is that legally you don't need Congressional approval to put troops in a country for a specified amount of time (something like 30-60 days).
He's saying that power (War Powers Resolution) is unconstitutional and is voided by the constitution which explicitly states war must be declared by Congress.
After 911 and with all his WMD talk of course the congress is going to keep troops there. Ron Paul doesnt try to scare people. That's why he is right. Other candidates use fear and emotion to get our votes. Ron Paul uses the constitution!

I agree with alot of his positions, but they are far too idealistic - not realistic. His interpretation of the Constitution, in my mind, is flawed. He opposes gov't involvement such as the Patriot Act and War in Iraq, but look at American history: The Alien & Sedition Acts of 1798, Lincoln suspended habeus corpus!

Paul; is full of shit, due to the doctrine of the "unilateral presidency" the President DOES NOT NEED congressional approval to take military action, the Constitution's article II powers names him as C-in-C. Should he have to get permission for most every military action from congress? Yes, but that is currently not how the constitution is written or has been interpreted. Goes all the way back to the Prize cases.

@MaiLingDolly I looked it up: "The President shall be Commander in Chief of the Army and Navy of the United States... when called into the actual Service of the United States." That last part can be interpreted as saying that the president needs a formal declaration of war to take military action. Otherwise, the War Powers Resolution of 1973 puts a limit on his authority.

@rmhism That's a good point, the Supreme Court has broadly interpreted Presidential power however in regards to the use of military force. Only in Youngstown Sheet and Tube did the Supreme Court check this his power explicitly. The War Powers resolution is congressional law also, which is not superior to constitutional law, it is inferior to it. A constitutional amendment would be far more effective in checking Presidential use of military power but we'll probably never have that.

The Constitution states that Congress shall write no law endorsing a national religion. So, at least at the federal level, there is no interweaving of government and religion. The most important freedoms are pretty separate from economics (press, religion, speech, etc). Anyway, now I live in a country that has less economic freedom than America, but has a higher standard of living and better health care (I live in Japan), and I like it much better that way.

Doubt what he said was stupid. When Iran, a terrorist state, acquires nuclear weapons they could well help others acquire the technology. This is not a state that has the controls that the United States has, its hostile and keen to bring down its enemies and civilians will be a target. At the moment they are held back by the fact that Israel, a democracy, has nuclear weapons but with a technology as powerful as that they will surely become more brave and Iran is no friend of America.

The only thing in short supply regarding nuclear weapons is the nuclear material itself - and "short supply" is a lose term, since there is actually a lot of it, it's just not easy to get ahold of.

Huge difference between a small dog and a missile even a medium range missile something which the Iranians already have. Guess if you strap the dog to the missile it would possibly work, or if you tie rockets to the back of the pickup. Nuclear material in the wrong hands can never be good and Iran is not exactly the friendliest country. Bad other countries have it.

The act was passed to resolve the conflict that your supposedly inerrant document, the constitution, created when it declared the president commander and chief but gave congress the right ton declare war. I agree with alot of his positions, but they are far too idealistic - not realistic. His interpretation of the Constitution, in my mind, is flawed. He opposes gov't involvement such as the Patriot Act and War in Iraq, but look at American history: The Alien & Sedition Acts of 1798, Lincoln suspended habeus corpus!

To me, Democrats' social overspending, not the Fed, is the real problem. Regarding past presidents, Paul bases all of his positions on the Constitution, and makes it a point to say that Bush's actions (or Romney's hypothetical in this case) are ridiculous, even though the ppl who founded this country exerted far more exec. power than Bush.

The Bush administration bent over backwards for civil liberties in crafting executive orders for the war on terror by the founding fathers' standards. @evo1137 Congress is charged with coining money for the U.S. Instead of doing their job, they delegate that job to a private bank to control our money. Not only is it unconstitutional, it goes against common sense. Why should we pay foreign, private bank interest & allow them to set economic policy? B/c they do such a good job? Look at us now. Why isn't it realistic to think we can control our own money? Why is it idealistic to think we don't have to unlawfully invade & occupy others?

@Marleyites Your questions are certainly fair, and I will attempt to answer them. Whether you agree with the constitutionality of the Federal Reserve or not, it is an institution, that, at this point in time, is highly critical in regards to the actions of banks and exchanges (stocks & currencies, for example). Does it seem realistic to tear down such an institution and risk destroying our entire economy? Regarding the war, I don't know which war you are referring to as "unlawful."

@evo1137 The Fed is highly critical of banks & exchanges b/c they are all competitors of the Fed & the banks owned by those who own & run the Fed. The free market & competition are the bedrock of a sound economy. This centralization of power in one private banking group is dangerous for We the People. It's great for the politicians who get payoffs aka campaign contributions + jobs, from the Fed. Our economy is already destroyed. How can giving power to the destroyer help? Use common sense!

It makes me sad to see this.. Paul should have gotten the nomination. He would have destroyed Obama in a debate. Just look at the energy and hear his tone when he speaks. I really believe that had he gotten on national TV and had a chance to debate Obama he would have ripped him to shreds. All of America would have been fully exposed to Paul's ideas. But sadly, a bunch of idiot neo-cons are in control of the Republican Party. Hopefully they can be driven out in the coming years.

you're adorable! This WAS nationally televised. The debates on both sides were. The idea that he couldn't win the nomination but he was going to somehow win the general election is insane?!?! I love Ron Paul, but I don't think a constitutional law professor like Obama would struggle with this question the way Romney did. I think as a general rule, if someone can't finish in the top 3 in their own primary, they wouldn't "rip to shreds" the oppostion in the general election. You're an idiot sir!

And my point wasn't to say Obama would have struggled with the question. My point was that Paul had more fire in him than McCain or any of the other so-called "Conservative" candidates. And he had the brains and philosophy to back that fire up. It's sad he was treated so horribly by the same people who are now pushing most of his ideas after they lost office!!

and as far as "the right candidate," our votes mean nothing. varying degrees of nothing, dependent on your state of residence, but still, nothing. no american (outside of the electoral college) has ever elected a president. we say that we're a country of democratic ideals where everybody has a say. this is not the case, and if you truly understand how small

presidents only have the power to command the military, autonomous of congress, because nobody has challenged his authority to do so. the president wont challenge it for fear of losing that power(and all the others that are unconstitutional, but utilized anyway), and congress wont challenge it because if they lose, they lose all authority to regulate the president's power. its a stalemate, and the only guidelines are those in the war powers act. it is sad that we allow this disregard for the law
