I want to add that under no circumstances should you really go to trial, that is a formula for disaster, you just want your Public Pretender to think that you are stupid enough to do it. A one year sentence is something they can live with and not look soft on crime. You have to plant the 1 year seed early and let that thought develope, they don't want to go to trial any more than you do. If every single case went to trial they could only handle 5% of them, plea bargains rule the day. Good luck!

The name of the game with plea bargains is brinksmanship, they are going to hold doomsday over your head hoping to make you accept a cruddy deal. Let your PD know you would be willing to cop to 1 year. The DA will reject your offer out of hand and make a shitty counter offer. Do not under any circumstances accept any counter offer until 1 minute before trial. My bet is that they will accept your 1 year offer rather than spend a day in court. Do not lose your nerve, no deal until 1 minute before.

@john146only: My response to any kind of argument like yours is "Why is alcohol legal?" Are you saying that people operate on all cylinders when they're drunk? The good thing about people who get stoned is they tend to stay home .. and eat.. and be lazy. Obviously that is not always the case, but I have never seen someone "stoned out of their gord" looking for a fight. The majority of DUI's come from alcohol, not drugs. It is possible to overdose and DIE on alcohol, not with marijuana.
