In fact, in the full video he locks back the slide before asking his assistant to verify the chamber's clear. He then puts the full magazine back in the pistol and drops the slide.

Obviously the slide can be locked back at any time (manually), but at what point do you see him remove and re-insert the mag? Show me. So, if the mag was in there, it would either have had to be empty when he racked the slide back, in which case it would lock automatically, or he had to lock it back manually. I doubt it was actually loaded anyway, because you can clearly hear another agent say the weapon is clear.
If there was no mag and he locked it manually, then so be it. But he never inserts a mag before releasing the slide. Anyway, based on what is shown here I'm fairly certain it's fake. He wouldn't be standing up walking around if he just blew a hole in his foot with a .40. Where did you hear he sued? If you pay attention, it look as if he pulls and locks the slide back with a full clip still in the gun which will ready a round to be loaded. so when he unlocks the slide as he is holding it, it loaded then he pulled the slide back to lock it again but it slipted out his hand and that hammered the round.
He hit the slide release with a magazine in the gun, I don;t think the slide slipped out of his hand.
