What makes you think that the Alien Tort Statute, which authorizes these suits for actions in the U.S. or on the high seas, has additional extraterritorial reach? The laws of one country don't usually apply in another. And people will still be criminally liable, because this case is only about civil liability. Nobody actually "gets the right to commit genocide" whatever the outcome.
