The point is, ultimately, that it doesn't matter who enters your home, regardless of what uniform they may have on. If they're entering your home and you know you haven't done anything illegal, you must assume the person or people are entering YOUR home illegally, and take measures to defend yourself. If someone is pointing a gun at you, you must assume that person is going to shoot you. And evidence will show that just because the person is wearing a uniform doesn't mean you're safe.

What our governments have created is highly trained militia to do investigations and police work. The police were never meant to carry out operations in this manner.

And besides, a search warrant is only that - a *search* warrant - not a license to go into someone's home with guns brandished. If their only purpose was to search the home, they could have done so when he wasn't home with his family. There was no reason to shoot him. The safety was still engaged on Mr. Guerena's gun!

The truely fucked up thing about this is when this Marine was in combat due to the rules of engagement if he were in the place of the police he wouldn't have been able to shoot until one of them were shot at. Regardless of whether Guerena was involved on drugs or not, the bottomline is that our constitutional right is what is in question. We are ALL supposed to be innocent until proven guilty, and that constitutional right was not given. This could have been sorted out in court and the life of a vet could have been spared. Maybe he was guilty...who knows?.... but there are always two sides to every story. If he was indeed guilty then let the punishment fit the crime.

They still haven't released the forensic analysis of the gunfire, so we don't know that Guerena fired no shots. His gun was on safety, but he was alone in that house with his rifle for an hour. Plenty of time to switch it while he lay there dying.

I hadn't heard that it was the wrong address, although that's really besides the point. First off the sheriffs department wasn't dressed in all black, they were in their sheriffs greens. Second they sounded their siren and yelled numerous times it was the "sheriffs department, search warrant". The fact is it was all a big misunderstanding ultimately caused by the gentleman's wife which tragically cost a man his life.

The point is, ultimately, that it doesn't matter who enters your home, regardless of what uniform they may have on. If they're entering your home and you know you haven't done anything illegal, you must assume the person or people are entering YOUR home illegally, and take measures to defend yourself. If someone is pointing a gun at you, you must assume that person is going to shoot you. And evidence will show that just because the person is wearing a uniform doesn't mean you're safe.

And besides, a search warrant is only that - a *search* warrant - not a license to go into someone's home with guns brandished. If their only purpose was to search the home, they could have done so when he wasn't home with his family. There was no reason to shoot him. The safety was still engaged on Mr. Guerena's gun!

We are ALL supposed to be innocent until proven guilty, and that constitutional right was not given. This could have been sorted out in court and the life of a vet could have been spared. If you find the news report I mentioned in the last post, off to the left side of the screen is the .pdf of the search warrant affidavit. You'll want to read that affidavit. The entire family was involved in the crime ring. All are living affluent lifestyles, driving nice newer vehicles, with no visible means of support WHILE receiving state welfare checks. US Marine or not, Jose' was a criminal.

@votingronpaul2008 you can see the flash in the video before the cop fires. I doubt it's a muzzle flash, but if someone were pointing a rifle at you, it might easily look like one. They still haven't released the forensic analysis of the gunfire, so we don't know that Guerena fired no shots. His gun was on safety, but he was alone in that house with his rifle for an hour. Plenty of time to switch it while he lay there dying.

They conducted counter-surveillance on case detectives and THERE'S WHY a tac team was called in. ....."Jose Guerena's home was searched that morning after his death, and officials found body armor, guns, a rifle, a dozen cellphones and a hat with the U.S. Border Patrol logo." This never should have came to this, but you can't blame the officers for defending themselves against a threat. If anyone's to blame for this it's the wife for freaking out say there were people outside with guns failing to realize it was the sheriffs department. If this gentleman hadn't been a marine no one would have given a fly fuck. Anyone serving a warrant would have fired in this instance facing down a man with a rifle aimed at them, while yelling "bring it on".

I hadn't heard that it was the wrong address, although that's really besides the point. First off the sheriffs department wasn't dressed in all black, they were in their sheriffs greens. Second they sounded their siren and yelled numerous times it was the "sheriffs department, search warrant". The fact is it was all a big misunderstanding ultimately caused by the gentleman's wife which tragically cost a man his life.
