Hemming has parliamentary privilege to bypass the injunction. The BBC cannot be held liable for live events, especially when they come from the House Of Commons. The YouTube user is not liable at all as he does not own this footage nor does the user break the superinjunction.

@InappropriateSurname what about if someone breaks a super injunction they don't even know exists? For example, nobody has told me about a superinjuction for Ryan Giggs or Gareth Barry so can I still go to jail for 1000 years? If so who should I email my address etc to so they can arrest me?

@InappropriateSurname MPs are protected by Parliament Privilege. The press have a legal right and are free to report on ALL debates in the House of Commons and Lords, ergo, once the print press (usually), or as in this video clip, a TV station has transmitted it, it's out there.
It's a very old law, no wonder the judges want to get rid of that law.

John Hemmings can and I guess will continue to name names, he has parliamentary privilege to rely on so he will not face legal proceedings for doing so. Think his concern is the mockery that is being made of the justice system by the rich to hide their infidelities, when most quote the harm it would do their families, they never seem to think of it at the time they are conducting their affair. @1984ekul man i'm angry with giggs as much as any one could be because this guy was the last role model i had in english football, but at the same i recognise that what he gets up to has nothing to do with any of us. i just think it's wrong that newspapers and twitter would rather focus all their attention on this story instead reporting on the systematic rapes that take place in countries like the congo dr, or what's going on in libya or syria.

@TKManUTD1989 Yes, I'm also especially disappointed given Giggs' long-standing status as one of the great role models in British football. But you've got to remember that no-one forced him to become a footballer. He took up the profession by choice, and thus he chose to be in the public eye. I'm afraid that the super-injunction was his way of trying to have his cake and eat it too... and it's backfired horribly. If his wife has any self-respect, he'll be sleeping on the front lawn tonight.
