@SirJACthe3rd its not a problem with fair use, its the asshole taking it down. TimeWarner this year admitted they issued massive takedowns of content they didn't even look at, and the content wasn't even theirs. corporations have a lot of power to ruin your internet experience
NBC is blocking a public domain video I have posted, it is not for profit, there is commentary about the Video, It is not the entire news cast and therefore a clip, It is a new news piece and not the same intent of the original broadcast.
They refuse to respond to the dispute.

@stanfordcis Is it classified as fair use if i recorded my own video for a copyrighted song but play the actual song I bought on iTunes over the video when I uploaded it? I created my own version of The Lazy Song - Bruno Mars music video, using my own storyline and not much of the original dance. This was for a school assignment. It was non for profit. Please help?
I took 2 songs from Itunes that I paid for and put them on my video in the end I put in the credits Paint it Black by rolling stones and Uprising by Muse. I am not making money off of this and in the description I said I am not making any money and I Am doing this out of Fun is this fair use?
Here's a question. I play music by ear (I can't read music) on my sax and post the recordings I make on my channel. These are tunes I haven't composed, but these are my interpretations of published tunes composed by others. Am I infringing copyright? Or is it fair use? I don't want to infringe copyright and I'll remove them if I am.
I am truly thakful for the information and commend Youtube and Goggle for the information.I try my first movie with windows movie maker and was completely shock by the aftermath that came with it.I did not quite understand all the ramifications associated with creating a small movie of family having fun @ halloween.
If I use footage from a video game to create a top 10 list of best games from a certain year, like top 10 best games from 2009, is that protected from fair use? I might see it the wrong way, but doesn't saying that a game is one of the best games released that year promote sales? Please tell me.
This video has info that is very important for what I'm doing on my channel (teaching music, mostly Radiohead). After 5,900 subscribers, all of a sudden I'm getting flagged by Warner Chappell... Fair Use is so tricky...
I hate when unimformed people who upload entire feature films onto youtube add something to the description like "It's fair use for me to upload this because it's for educational purposes." Ummm no, it isn't. It's not the fact that they uploaded the movie that bugs me, just the fact that they don't have a clue about what fair use really means.
@Vuorenpeikko If you're using the original work and all you are doing it reposting it with a translation, then most likely no. It's not transformative, or creative, plus they might want to sell it in other languages themselves, and they would reserve the right for that.
I have a video of a road rage incident i have posted on you tube, and a local current affairs program has taken the footage and used sections of it in several of there stories bout road rage ect, I would like opinions of if they are allowed to do that?
this didnt really give me a clear answer, or maybe i just missed it.
"I am at an event, restaurant, or other public place and a band or the radio is playing in the background but I do not intentionally record the band or radio. I am filming something else. The music is out of my control. Is this fair use?"
Their answer: Yes
Correct answer: It depends on how much of and the clarity of the band/radio you record and its dominance relative to what public stuff you're recording.
No closed captioning? No visual examples? Just talking heads? I appreciate the information, but the presentation could have used more work. Why not do an individual video for each question?
YouTube really needs to cut it's ties with the record labels that have caused all of the false flags and DMCA abuses. If it were up to me I would terminate all of the accounts belonging to universalmusicgroup, warnermusicgroup, and Viacom.
Thanks for this video. I appreciate your commitment to this, on Youtube, to inform everyone how to use YT. It is good then maybe we can avoid the haters who claim to be the legal owner and we violate copyright law. Thank you, Larry.. Have nice weekend (R)
I have covered alot of songs online, I owe those artists a debt of gratitude...I've listened to thier music all my life! I mostly use them and perform them for educational or entertainment purposes.
What if I wanted to change the lyrics of a song and play it myself for comedic purposes, but it was not a direct parody of the song itself? i.e. the lyrics were no longer related, but to make fun of some other subject.
Still a lot of grey area, but it answers the questions/myths that people have about fair use. But it still comes down to what the Copyright owners actually do.
@fouseyTUBE Because some copyright owners care and others don't. Youtube is not screening every video to make sure there isn't copyright infringement, they only take action if the copyright owner contacts them.
Oh man, so many grey areas. I do wish copyright would get refined or replaced. I love Creative Commons, but it too has grey areas when it comes to the non-commercial license...
However the logic toward the beginning is somewhat comforting: would the copyright holder pursue you, and if they do would discussing your stance have favorable chances of working well with the copyright holder.
@WHATTHEBUCKSHOW Couldn't agree more, as somebody who operates under the news heading, I've avoided using pictures 95% of the time. I think I'll be able to use photos more often now with confidence.
