What I believe is the following: 1) I have as much right to film in public and freely distribute what I record as a news reporter or photographer, and 2) people who violate various provisions of Title 8 of the U.S. Code and Sec. 17200 of the CA Bus. & Prof. Code are behaving unlawfully, regardless of whatever excuse/sob story/prevarication you want to offer as a "justification".
