The police are public servants, people have a right to ask them questions. They do not have a right to threaten arrest under terror laws to anyone who does anything they don't like.

The only authority police have is to uphold the law - if no law is being broken they have no more authority than anyone else.

That seemed quite naive to threaten terrorism powers. They actually arrested him under section 60 of the CJA. Not terrorism act.

However, they also have a rights not to answer questions of a personal nature such as an opinion etc and not to be harassed. The same rights you and I have.

Additionally, under section 110 of SOCPA you *have* to give your name. If you gave a fake name then I suspect it 'would be used in evidence against you'.

Let me make this clear - if you are stop and searched under the CJA you do not have to give any details to the police - and they can record only descriptive details. This video is about stop and search - not arrest. Nobody is arrested in the video although it is threatened.

Also, police are public servants, people are free to ask them whatever they want to. They don't have to answer, but to threaten arrest because they don't like being questioned is an abuse of their position of authority.

The policewoman was well within her rights not to answer the questions of the highly sarcastic "I'm better than you" interviewer even if she is a 'public servant'. He was extremely arrogant, demanding and harassing her.

and I apologise I misheard as I thought the unidentified policeman said he was arresting the 'friend' under the CJA but listening to it again it was a bit clearer.

I couldn't find anything in the act that limits what the police can look/ask for in a stop and search or whether they can take the name down of the person they are searching.

I was stopped and searched on suspicion of theft once but as I knew I was innocent I was polite with the police and they were polite to me. It goes a long way!

First time I was stop and searched the officer was polite, I answered all his questions and gave my personal details - after all I had nothing to hide.

But when I thought about it, I was being complicit in the forming of a police state. What did my grandfather fight for in WWII if our nation was going to end up like Nazi Germany by our own design? With the exception of the first bloke who was interviewed and the ginger-haired girl giving ill-timed legal advice, all the rest of the people featured in this film were being highly confrontational and immature.

I think you may be misinformed re the demanding of name and address by the police in the uk. I believe that under terror legislation they can demand ID, even arrest you to ascertain your ID (even if you have proof) from anyone at any time. Same with searches.
