He didn't plant Monsanto's seed, his field was contaminated by Monsanto's seed planted in a neighbor's field - thats a huge difference and something over which he has no control. A gene with an effect can spread to your crops unintentionally, and they have a right to claim ownership over that patent they evidently failed to physically protect, that essentially infected someone's property?
If someone made a contagious virus (even one with beneficial effects), that you picked up, would they own the gene material inside you? Patents should not be able to infect.

With the boom in renewable energy sources (especially mais for bio-gas)I believe the subject will be of great importance here sooner than many would have expected. I think they might work in about 50 to 100 years. Right now we know gene order is important, but not how. Gene order is always interrupted with transgene insertion. We know transgenes often bisect host genes - not good. We know that transgene fragments are always inserts compounding the above problems - not good. We know that gowing from tissue sample (as all GM crops are) can cause genome-wide mutations - not good. Could go on, but space is limited...

Percy bought 720 liters of Roundup in the spring of 1998.
He did not buy the Muster and Assure herbicides which he normally used.
He then testified under oath that he was unaware his crop was Roundup Ready.

No one else had the problem then, no one is having this problem now.
