No, Jailbreaking is not illegal, it will only void your warranty if you send it to Apple jailbroken. If you restore it to normal ("un-jailbroken") then you can send it in to Apple.

Unlocking your iPhone to work with different SIM cards is illegal ;)

hey dude i had the same problem as you, u got to fully turn off ur ipod touch and then unplug the usb. then hold the square button and plug ur usb in then it should let u continue.
