  • does a synth cover of a song qualify for fair use?

    no one would come on my video to record the song to put on their iPod because 1) the song isn't good quality because i recorded it with my iPhone. 2) i'am playing my synth over parts of the song.

  • @DilanFIlmScore Usually the video is restored instantly but the content claim won't go way until it is either released by the claimant or expires, which I think happens after either two weeks or a month. Try logging out of your account and see if you can view the video or not. It might not actually be blocked, just the copyright page didn't change and says it's still blocked when it actually isn't.

  • @amityadavify A disclaimer won't prevent your video from getting blocked. You still have to file a Content ID dispute to get it unblocked.

  • @Flash7425 You should be able to use this dispute method. If for some reason the dispute button doesn't show up, there's a URL trick described on my website you can use to get to the dispute page anyway.

  • @usmcoth Well the dispute form does have a space where you can say you purchased a license, though you're right it doesn't have anywhere to write a number. And I absolutely agree you should be able to purchase a license directly from YouTube. I wrote a paper on that to enter in an essay contest, and I'd like to work more on persuading them to do that.

  • You need to understand two factors that no body else is seeing. First is that YouTube does not permit anyone to enter a license number (like a CCLI) which permits them to use the "violating" music and Second is that they could simply offer a single (or group) use license to be purchased by the uploader.

  • maybe you can update the video to go along for the update youtube as many of the buttons you are choosing are no longer on youtube on the same way they were when you made the video so an update is needed

  • @SeeKacee It's still basically the same. Some of the buttons now say different things, but it's still the same basic process and the dispute form hasn't changed. I think people can figure out the minor differences.

  • Does this work for hour long mixes? I did an hour long mix and posted it to YouTube. Later in the day I saw that it was muted. The whole mix contains several songs, so there are several claims, but not all of the songs are claimed against, yet the whole thing is muted. watch?v=zaozcN0KB8g this is the mix which is muted.

  • This is cool, I'm glad you are helping people. What would I have to do if I wanted to upload a video with a copyrighted song without my video getting muted or getting a notice? Should I just state in the description that it is fair use and such?

  • @cooljoe494 Well you could do that but it won't stop it from getting flagged. The only way is to wait until it's blocked and then dispute it, and even then that rarely works anymore because they just re-block it.

  • @2BCBattlefield Typically you'll get an email if there's a Content ID match, and no notice at all if there is a DMCA notice. In the latter case, you'll just log in one day and there will be a strike against your account and you have to watch the Happy Tree Friends video (see my other video for my response to that).

  • @2BCBattlefield No there's usually no message at all, except for Content ID matches. And no, nobody goes to jail. The video is just deleted, that's all.

  • I once put an image of an animated character from some kids show as the background of my music video. It was just a picture and my music.

  • @Willpower1213 If you believe your video constitutes commentary or criticism of the songs, then it could be fair use and you could dispute it if it's blocked. If it's not blocked, I wouldn't worry about it.

  • @squatjoggerone I think it's still copyrighted, but it uses a creative commons license which allows you to use it for free as long as you give credit to the original creator, which I'm guessing if you're using the YouTube video editor it does automatically, though I'm not sure about that. The license status can change though, so even if it was okay to use it at first, it might not be okay later.

  • @anoj810 If you actually get as far as getting a strike on your account, then you can use the DMCA counter-notice process to get your video unblocked again. Problem is you have to get a DMCA takedown notice to use that, and those rarely happen anymore since companies just use ContentID to block stuff, and usually Content ID disputes don't work because the content claimant just "confirms" their claim, after which there is no more dispute. If you get a strike, you can counter-notice.

  • @FnVgaming Possibly. I can't say for sure one way or the other, but I think often video game playing videos would be fair use because the user's interaction with the game is transformative.

  • I have created game walkthrough videos containing about 10-20 seconds of AC: Brotherhood music I purchased from iTunes, and mixed in Windows Live Movie Maker. I added them to only parts of the video that have been altered in speed. The recorded sound in the game (background music) is included with this. The videos are simply for educational purpose regarding Hitman: Blood Money. Can I dispute?

  • @DirectedMan Personally I wouldn't dispute unless a video is actually blocked. I'm afraid I can't give you advice about whether you video is fair use though, so you'll have to decide for yourself based on the information on my site and elsewhere.

  • @DirectedMan I've received dozens of notices by Music Publishing Rights on another site with lots of old, public domain movies. I always dispute them and the notice is always removed. Safe also to dispute the following; The Orchard Music, GoDigital, Music Video Distributors, eOne, AdRev, ShemarooEnt, DashGoAudioBee. I believe these companies are bogus and are trying to control ad revenues. Be wary of disputing Warner Bros and Universal.

  • @Jukle0 Possibly. I believe amateur cover songs are often fair use, though there's no way to know for sure. There is actually a statutory method for purchasing cover licenses, but its applicability to YouTube videos is less than clear, and I doubt it was really meant to apply to amateurs singing songs in their bedrooms anyway--more for professional musicians selling cover songs on CDs.

  • @DarkLordofDebate Thanks for the reply. I tried the dispute, and it removed the claim. When I look at my account status the Copyright Strikes says my account is in good standing, but with the Content ID Claims, it says my account is not in good standing.

  • @Jukle0 That's probably because the Content ID claim is not actually gone, just suspended pending the copyright claimant's response to your dispute. Cross your fingers that they'll either ignore it until it expires and goes away on its own, or agree with your dispute and withdraw their claim. Otherwise it could end up blocked again with no further way to dispute it.

  • Thanks for the video, i have a notice saying my account is not in good standing - view copyright notices - i go to this and it says that i have matched third party content. the video is not blocked. basically i have made a video of myself and then put a song over the top, is this copyright infringement, should i dispute? when i follow the help, it says no action is required on my part but it doesnt seem good that my account is noted as not in good standing. can anyone help with this? thanks

  • @thelastpaine I'm pretty sure it only says you're in bad standing if you have a video that is globally blocked, not just monetized or blocked in a couple countries. View the copyright info in detail to find out if it's blocked or not. And yes, any use of copyrighted content is potentially copyright infringing. It's up to you to decide if you think it's fair use or not so you can dispute it if you want to. The information on my site should help you with that.

  • Do lyric videos count as fair use? There are lyrics videos all over youtube, in fact it's how most of the world listens to their music, but they blocked mine. I just want to know if it counts so I don't feel foolish trying to fight it. :C

  • @Agirlinanotherworld I rather doubt it. To have fair use you typically must have altered the original in some way or at least done something to set it in a new context providing new meaning and message. There are ways to make full use of a complete unaltered work, but that's more difficult. Lyric videos just post the full song along with its lyrics, so they don't really change anything, and could arguably compete with the market for the original, so fair use is unlikely.

  • Hi. First of all, I want to thank you for the tutorial. However, my video got reblocked after I sent in the dispute form, and it said something like "this was reviewed by Warner and the copyright claim remains", I forget exactly. I finally gave up and just deleted the video, but all I was doing was singing over a song. Is it possible that Warner just ignores disputes?

  • @GuineaPiggeh Unfortunately yes. I still recommend people try disputing as occasionally it works, but more and more the dispute process is a total joke, as copyright claimants are free to ignore the dispute and re-block the video, after which there is nothing more you can do.

  • @DarkLordofDebate could you help me out? I have a montage with a remixed song, i have got "matched third party content", what does this mean? Does this mean i can't get partnered with machinima or youtube unless i remove it? Also could you check and make sure that the audio isnt copyrighted?

  • @tr1ckygamer That means it was flagged by Content ID as containing a copyrighted song. As long as it's not actually being blocked by Content ID just monetized, there's not much to worry about, but I do believe having Content ID matches on your channel can disqualify you from being eligible for a partnership.

  • @tr1ckygamer I really can't give an opinion about whether it should have been flagged or not. If you disputed it, it may stay gone, or the copyright owner might reinstate their claim and it would come back. You'll just have to wait and see.

  • @Yoshikarter1 Well if you just have unaltered copyrighted audio and no video with it that could make it fair use, you don't really have a basis to dispute it then either.

  • @12ILOVEMCR If you made a video showing the lyrics over the song, the song is still copyrighted, and just showing the lyrics isn't really transformative or fair use, so that probably is really infringing. Sorry.

  • @Greco412 More likely they're claiming copyright on the music in the game. In the context of a videogame play through, that could be considered incidental use of the music and could be fair use.

  • Well to be fair, if you could just break these copy right laws there would be no business or jobs.

    Imagine if you could download music for free? who would buy it? who would want to be a singer if you make no money? who would work in the factory for nothing? Who would bother making a recording company?

    You would make loads of people lose jobs!

  • My hat is off to you for this video! I am in a similar situation. Not only is my video fair use, but I also FULLY CREDIT all three original artists CLEARLY in the end credits! YouTube can be screwey at times.

  • @LoneSoldierRyan Well if you deleted the video there is nothing more you can do except wait 6 months for the strike to (maybe) expire. Otherwise you can still send a counter-notice.

  • @LoneSoldierRyan Well if they want the video to stay down after a DMCA counter notice (not a Content ID dispute) they have to sue you, but in the vast majority of cases they don't bother. It's really not worth it most of the time.

  • @MrBenPratt Yeah I suppose you could do that if you want, with minimal risk to your channel since usually the vid is just re-blocked thru content ID not a takedown with a strike. I imagine it would get pretty annoying re-uploading and disputing it constantly though. I would think a better option would be to upload it to a site like Vimeo without a copyright filter and have a pointer video on YT with a link in the description.

I had a message that my account may not be in good standings also the video was blocked and there was a message there for about a month that they had not had a chance to take a look at the dispute... then a couple days ago the not being in good standings message and the this video is blocked message were gone also the video blocked message was also gone the video plays but not the sound... the sound is what has always been blocked... thanks for your time

  • @MrFoulG Check the copyright info page again. Maybe you didn't actually win. Otherwise, if the audio was disabled before, maybe the system just hasn't rolled over yet, and it will come back in a little bit when the system updates. Wait a few days and see if that's the case.

  • @Coolbeat Are you sure it wasn't blocked by a DMCA notice (or perhaps a terms of service violation) instead? Sounds like your vid might not actually be blocked through Content ID.

  • @Coolbeat Okay, so you can get to the "view copyright info" page and see the list of countries it's blocked in? And you can click the dispute button, but then it gives you an error? Sounds like it might be a malfunction then. Hopefully it will fix itself, because there's probably nothing you can do about it. Even if you did dispute, EMI would most likely reinstate the claim and have it re-blocked anyway. I've discovered personally that it's impossible to dispute claims by EMI.

  • I have a 40second long clip with content by FOX. They instantly shut down my video. What can I really do about it? 40seconds is almost Nothing compared to the actual movie, and i spent many hours editing this little project. :(

    Plus, there's TONS of music videos etc with the same content i've used... I did the dispute, but it doesn't seem to matter. I put my disclaimers in the description aswell. Gah.. this makes me sad!

  • @h0lmb0m Sadly, if you already disputed it and they reinstated their claim, there's nothing more you can do. Eventually maybe YouTube can be pressured into changing its policies, but it's going to take sustained pressure from bad PR and media coverage to motivate them to actually change anything.

  • @AbdullahAkron I don't see why you would have any problems with that. It's generally considered legal to jailbreak devices you own, even if the manufacturers do their best to discourage it. Nothing is certain though. Sony went after a guy who published tools for jailbreaking PS3s even though they had no legal basis for doing so. But I doubt you have anything to worry about just making tutorials about it if you're not actually writing hacking tools.

  • Uh... hello! It's me... again.

    One of my videos have been removed due to copyright infringement. Now this sin't the fist time it happened. I did the dispute process, and now after 5 months, they decide to say thast I'm abusing the process and put me through "copyright school".

    I could have filed a counter notice, but if they believed i was abusing the system AGAIN, I could probably end up in jail.

    How do i prevent something like this in the future? It was Bleach Opening 3 AMV - Rain.

  • @KidAnime20 There was probably a mistake. Just send another DMCA counter-notice with a more detailed fair use rationale in the "message to YouTube" box (like one of the ones in the guide on my site) and you should be fine. YouTube shouldn't reject good faith counter-notices as long as you provide them with some legitimate explanation for why you believe your video is fair use.

    I guess I didn't decide to do that before is because I felt that regardless of how rational my counter notice would have been, I feared that they would still press charges against me for it, and they can!

    I didn't think it was worth the risk over an AMV.

    Not commercial -- I do it for fun. I've gotten quite a few content ID matches, as well as two videos pulled (with two strikes) because of a complaint from the c/r owner (both were of me playing along to two songs by the rock group Supertramp.

  • What about videos that you took when you attended a concert and uploaded it on Youtube? Does that count as a copyright violation? 'Cause only one of my videos from the same concert got a claim that it's a Matched Third Party Content.

  • @AnimeMasterShirota While a lot bands allow that, there is actually an express provision in copyright law outlawing recording concerts. So I'm afraid that is a copyright violation.

And there are also other Youtube users who uploaded the same song from the exact same concert and how come, it seems that they haven't gotten that Matched Third Party Content claim on their videos?

  • @AnimeMasterShirota Who can say. The Content ID filter is more error prone than you is imagine. There's really no way to explain what it catches and what it doesn't.

  • What is the material your using it owned by someone in another country? But you live in the US would the video fall under your copyright laws or their's?

  • @Watermoona The US has signed treaties where we agreed to give copyrighted works from other countries the same degree of copyright protection they would have if they were copyrighted in the US--no more, no less. So yes foreign works are protected by copyright, but only to the extent they are protected in the US. US specific exceptions like fair use still apply, though only in the US. Your video could still be infringing in other countries even if legal in the US--hence YouTube's regional blocks.

  • Usually for me, if I get the answer right away, it's okay. If the dispute is waiting, it means no.

    Right away = Yes.

    Waiting for attention = Immediately no.

  • @97kevinhuanle Odd. My experience is the exact opposite. If they are going to "confirm" their claim and re-block your video, they usually do that within a week. If they're going to let your dispute stand, they just lit it sit awaiting response for about 6 months, and then eventually the claim goes away.

    Hmm.. some one told me there's a way to "cheat" the Content ID system. You need to put another piece of copyrighted material (risking the chance of getting detected for 2 different copyright claims) of something that won't remove, and accepts your video. Then the rest is ignored... I don't know. I haven't tried it yet.

  • Helllo i made a lyrics video for a song and the company INgrooves claimed rights to it.Its a song with the lyrics and a picture of the album. If anything i was supporting the song and the band who made it,but youtube disabled my video. I don't wanna get sued or anything so what should i do?

  • @GRTx12 Unfortunately I don't think lyrics videos are transformative enough to qualify as fair use, since all you're adding is the text of the lyrics. However if you still think your video is fair use, you are free to file a dispute.

  • @DarkLordofDebate It saids not to miss use the abilite to dispute. Is it possible they could sue me if they think that it is not a valid reason of fair use? also i have other lyric videos that are have a good amount of pictures of the bands they belong to with the song and lyrics of course, i altertared some pictures and made the lyrics videos more than simply staring at the lyrics, would that qualify as fair use.

  • @GRTx12 I'm afraid I can't actually give an opinion on your specific video because that would be legal advice. However I can tell you that if you honestly believe your video is fair use, they can't sue you just for disputing. They could still sue your for copyright infringement (unlikely), but there are no penalties for abusing the dispute process if you have a good faith belief your video is fair use.

  • @DarkLordofDebate Well can please check out one of my videos i made? and tell me if it seems like fair use. my newest "we as human - double life lyrics video" that WMG is trying to claim. you don't have to but i would highly appreatiate it. also the copyright thing poped up on that video in less than minute after uploading it, do you know why? is it like a computer that searchs for this stuff.

  • @GRTx12 I'm sorry I can't give an opinion on specific videos since that would be legal advice. Just use the material on my site to make your own decision about fair use and whether to dispute or not.

  • @DarkLordofDebate I understand thats ok. its just that they taken down one of my videos, not that one by we as human as i mententioned but from another band they took my video taken down as well as almost every other upload that had that song expect for one video for some reason that i'm not sure of. i just don't wanna get sued or anything if they think this i have a false dispute.

  • hey so if I have a video that I'm dancing to the song, is that in any way savable? I was just dancing to the song, and I'm obviously not trying to make money off of it :/ if anything you can look at my channel, it's the only vid up on it. HELP MEH

  • @RenaissanceTuber Non-commercial dance vids are often considered fair use, so you're probably okay, but I can't say for sure.

  • Hi i have a video which is only blocked in certain countries. Does this work on my case too? I've already followed your steps..just waiting for the outcome now. How long will the dispute process roughly take? Thanks

  • @evoxpress It might, but it might not. The international aspect is tricky. Other countries might not have an equivalent concept to fair use in the US. And if your vid is blocked in Germany, it's almost certain to be re-blocked, as apparently German copyright law gives this organization GEMA the authority to control licensing for every copyrighted work in Germany, and as far as I can tell fair use doesn't apply there.

  • @HunGrrrEdits Sounds like a Content ID match to me, not a DMCA notice, so there would not be a strike on your account. With the Germany thing though, it will most likely be re-blocked there through Content ID. So your dispute will probably not be effective, but you won't get a strike either.

  • @completelyvirusfreee Go to YouTube's copyright help pages and they have a form which you can use to file a DMCA takedown notice. You have to actually own the copyright on the video though.
