I thought you could as long as you bought it with the 10 round mags. My brother bought one before he was LE and once he could produce proof they gave him the hicap mags.

i just put one on layaway.
i've never owned an XD in my life, and i dont even like a .40.. but i shot one of these recently and it really impressed me.
and its 16 + 1 .40 S&W. who can argue with that?
