The US code on people wearing uniforms was pretty much overthrown by the supreme Court Decision stating that a uniform can be worn when doing a theatrical performance or skit and it can portray the military in a bad light. If not commiting a crime he can say he was doing a "skit". Well, kind of - there's something called the Stolen Valor Act which makes falsely claiming to have earned a medal or decoration a federal offense, but it was ruled unconstitutional by some liberal hippie court, and is currently scheduled to be reviewed by the Supreme Court - hopefully the SCOTUS will uphold the law, and this guy will be tossed in jail where he belongs.

As for your question on whether he can be arrested, I have read some comments saying that he can be arrested for it, although i am not completely sure this is true. I certainly hope that it's true though because that douche deserves to be arrested.
