The narrator gives a VERY inaccurate recitation of court martial proceedings under the Articles of War as practiced 1861-65. Soldiers DID have due process rights- in point of fact Mr. Lincoln pardoned several condemned to death.
Remember, this was, for the most part, a volunteer army (esp. in Illinois- where conscription was never utilized). Politicians would have screamed bloody murder had this gone on without any right of appeal being afforded.
it looked like Charles Moore of the 104th who stole that time piece. I know him he had been leading the riot to free bryce. The command was going to execute him too but they knew he would run before they got a chance to shoot him.
