    There's a reason we don't vote on rights. It's because they are rights. I know this is a foreign concept to most people, but it was a fundamental concept to the design of our Republic.

  • Marriage is a Human Right not a a civil one. If I want to marry my dog, I should be able too. If you think this is wrong, that is because it is a behavior taught you by someone else. Your ideology is different than mine. If I think people should only be allowed to where the color purple that is an opinion, not something that needs to be a law.

    There is no logical difference between that view and yours, if you think their is you do not understand your own.

  • @thadrine Marriage is a Human right, but it is not an inhuman right you can not marry a nonhuman but because the rights of marriage is not covered in the rights of animals...to my knowledge only humans marry. Marrying be a legal and spiritual thing. Many species mate with one other of it's kind for life so mating is not a marriage thing (though I wonder if it should be.) I do like the argument though.

  • Let me just add that condemning homosexuality is not the same as making it illegal. I think it should be criticized like obesity, smoking, alcoholism (and such) are criticized. Homosexuality should not be paraded around as a legitimate alternate lifestyle choice, but people can choose that lifestyle if they want.

    Nor did I ever say that same-sex marriage should be illegal. Like I said, leave it to the states. That's constitutional. I prefer they say "NO," but if they say "YES", their choice.

  • Besides, these Propositions are state laws, not federal laws. If there was a federal law being passed banning same-sex marriage, John's argument holds more merit.

    If this state wants to ban same-sex marriage and the other one doesn't, well let the state decide for itself. Despite all the cries of "unconstitutionality" and "human rights infringement" coming from libertarians and liberals , sorry, but these are constitutional.. as per the 10th amendment.

    The propositions were not about banning marriage for members of certain religions or any sort of religious "bigotry."..

    Last time I checked, the measures were *only* to ban marriage against same-sex couples. Your slippery slope argument makes no sense.

    Religion need not necessarily be the rationale for voting for the Propositions..

    If you start defining marriage in the constitution, will the next thing be Catholics trying to define sex in the constitution? The amendment might say "sex is only for use conception" and then they can start outlawing birth control pills, condoms, and porn.

  • As I said. If the minor gets permission from his/her father/mother (a consenting adult) to allow pedophile marriage, what's stopping it.. besides, of course, common sense and morale sense?

    Legislating morality ,slippery slope? It seems to work all over the world. In our society, many of our laws are based off of it.. Including speed limits and putting drinking age limits. Legislating morality is hard and takes practice but doable.

    I choose to prefer to live in a SANE society, preferably one with lower STD rates.

    STDs spread rampantly through heterosexual sex, but as many studies have shown, the STD rates among homosexual men is much higher(if not several times higher). Official studies have not been done on lesbians to know equivalent rates for them.

    Your second point is non-sequitir. Having piercings, smoking, or drinking are different issues that, by themselves, don't directly apply to the theme of human sexuality.

    By your logic, only Lesbians should be allowed to marry and homosexual men and heterosexuals should be denied that right.

    Obesity causes all sorts of medical issues, including increasing substantially the risk of miscarriage. Therefore fat people shouldn't be allowed to marry because being fat affects their ability to procreate.

    HOWEVER, it stands to reason, that since STDs are transmissible through vaginal fluids, rates (particularly among the promiscuous) would be pretty high indeed.

    It's health issues that leads many to criticize Obesity. Likewise, homosexuality should be condemned not accepted as a legitimate sexual choice.

    I would oppose any measure to ban marriage based solely on religious belief (or lack thereof). It would breach the 1st amendment. One's religious beliefs has nothing to do with being able to engage in proper sexuality. This is more non-sequitir. Babies are born atheist. Can't say the same for homosexuality.

  • Babies are born without bigotry in their hearts. Homophobia and Racism are learned traits. The ban on gay marriage is a religious thing; perhaps you were molested or raped? Are you confusing being victimized by a sexual predator with the love of monogamous, committed same-sex couples? That is the only reason I can come up with for why an otherwise rational or logical freethinker would ever be opposed to gay marriage.

    First off, I am not a homophobe. As I do not hate nor "fear" homosexuals. They are people too. I am a Conservative that dislikes the behavior, that's all.

    Second, comparing dislike of homosexual behavior and racism is apples/oranges. One's a dislike of a certain human behavior, the other is dislike of a person just because of who they are (or born as). Likewise, I dislike alcoholism, a despicable human behavior (and behavior one is not born with).

  • There are tons of married, heterosexual gamers who are opposed to Prop 102 and Prop 8. I personally know quite a few; they are by and large libertarian.

  • Actually yes. The state has to respect the religion, in other words if the religion allows gay marriage, the state MUST allow gay marriage. Anything else infringes on how one exercises their religion. Hence unconstitutional.

    It's a good idea to study before you type, not just post text of the constitution, but how that text has been interpreted by the law.

  • This isn't the first time something like this happened. A man once looked a group of people he didn't like and decided they shouldn't be in his sight. Believing that what he was doing was right for his country, he made a law that stated that those people couldn't live in his country. His name was Adolf Hitler, and this simple belief caused World War II. Senators need to learn from the past, then look at our constitution before deciding what WE THE PEOPLE should believe in.

At first, it seemed that prop 8 would get righteously slapped down, but after the Mormon Church sent so many dollars from out of state to sway CA voters, I saw that popular opinion was headed in a nonsensical place and that MY VOTE COUNTS. only wish my well-reasoned and not at all emotional essay against prop8(which I wrote for my english 101 class) could be posted somewhere for undecided voters

  • Not saying this is a perfect treatise, but I'm with you. The government has two choices: recognize marriage or don't. They should not be able to dictate who can marry, as long as the involved parties are mature, sane adults.
