I'm guessing you're referring to the 2004 Athens Games? Well, whether or not he cheated then, he certainly deserves the title now--seeing that he's won the gold in both the 100 and 200 meters at this year's Beijing Games. And this time, everyone was allowed to do this alleged "dolphin kick," so yeah, he's earned it now.

Well he definetly deserves the title now and I dont think itd be controversial to say he is the greatest breastroker of all time. But the fact that he used a major dolphin kick in 2004 wasn't disputed, he just wasnt caught. Search for the video "kitajima athens 2004" and you will see the major dolphin kicks he continued to use even after he came under fire for them.
