in WA state, the pedestrian has right of way ALWAYS unmarked or marked, the second they step on the road you have to stop no matter what. however, COMMON SENSE, tells us, NEVER ASSUME the drive is going to stop........so anyways...did this lazy nurse win a darwin award or is she the crippledness?

My wife was a nurse. It's an exhausting job where they spend long hours caring for other people in need. A nurse gives a lot of themselves. You callously call this woman lazy when she was probably just tired/drained from a long, demanding day of giving care to others. LOL, that's funny, I actually was in the hospital and was cripplized, and had some great nurses, and they did not show their weaknesses. Just because you are tired, doesn't mean that is an excuse to not look where the hell you are going.

What happened to her was horrible (I don't know if she lived or not) but she had an obligation to look both ways before crossing a street and she failed to do that. The driver was also at fault but I don't believe it was 100% driver fault.

Places I've lived give the pedestrian the right of way at all times. The most prominent town I lived in for this situation was Ann Arbor MI - big University town. With so many students walking in the streets at any moment I had to be on my guard at all times. They don't have to use a crosswalk there. I think you and many others are conditioned to think that cars and pedestrians have the same rights - they don't. If you ever hit a pedestrian you are, by law, at fault no matter what.

Should the driver spend 10 years in prison for leaving the scene? NO!! That's ridiculous. A stiff fine at most.

If I were to resort to such a low level of thinking I would I could assemble a multitude of possible scenarios as to why the driver did not stop the vehicle.

The fact is this individual did not stop, but regardless of that there is evidence to show that the driver is not guilty of any crime, given the victim brought the injury upon herself.

Conjecture is not irrelevant when the offending party leaves a crime. That's something basic you learn pre-grad. When a crime is committed, one is not presumed innocent until proven guilty. One is guilty until proven innocent. Again, this is something basic. It's the reality, as you put it.
