Lol Just when I thought Vanille's voice had enough orgasmic cries, I see a panty shot @ 3:30...*sighs* Sheesh..cover yourself up when falling from infinite heights!
HCBailly most modern games nowadays have an option to just mute ingame music....this IS final fantasy though so Im unsure they even have this option...
Theoretically, you should be able to claim fair use. Practically, I know that you probably don't want to get sued even if you can win. I'd like to hear the song since I've never heard it before, but it's not my ass on the line, so do what you're comfortable doing.
If you're willing to cut the ending into parts, you'll be fine. In other words, stop the song mid-playing and don't post the ending all at once. If the song plays continuously, that's copyright. But if it posted in segments, then it's not copyright, so just split the ending up. But knowing the play style of you HC, you may not want to do that. lol
Why don't you mute just that part of the ending, and then play the ending score of another Final Fantasy game like VI or something. Make it a surprise.
Just thinking there, with the ending you can just do the full thing, due to the fact it is youtubes job to make sure nothing that is copyrighted is uploaded. so your basicly safe. youtube allowed the video to be shown there bad not yours.
With the lionheart with each strike you have a small chance of getting a instant full stagger gauge, even your frist striek of the battle can instant stagger.
My opinion, just mute the song. Your commentary and finale thoughts will be a lot better than that song anyway. Also, nice Tiny Toons reference. Nice work.
Can she rightfully claim the entire episode if only a portion of it contains her song? And, you know how a lot of YouTube videos will get around copyrighted material by mirroring the video? Is there some dumb little thing like that you can do to the song to make it a "new" file that is not copyrighted?
Yes, she can still claim copyright for the entire video, because it contains copyrighted material. There would really be no way for him to change the song, as even playing it backwards would still warrant copyright.
By change, I meant like a mirror affect. Unless somebody else has an idea, it looks like he'll have to mute the sound for that part, which is stupid that the artist is getting so uptight about the song being used in videos of the game's ending, because you can probably find it uploaded by a million channels.
HCBailly ~ I am a video viewer from the past (2009) and I have teleported 2 years into the future to tell you that I am stuck in the Tower of Fanatics in Final Fantasy 6!!!
I have run out of ethers and tinctures! What shall I do!?
If you're doing a commentary or otherwise talking over the song, like you do in your videos anyway, doesn't that kind of nullify it? I don't know the answer; I'm just asking.
As for the ending, if you have a song in a game, especially a popular one, you should expect it to be put online. I think the only reason copyright claims have been made is out of greed and people wanting to make more money off it. But, that's just my opinion. I'll watch the ending, even if you have to mute the song out and sing it yourself. =P
@juhzizz I'm not speaking of boss battles; I use them more for regular battles. If you want to synthesize Adamancy, though, you'll probably need a Battle Talisman anyway.
Adamancy is really helpful in boss battles because it drains 1% of the damage you deal to restore your HP. While that doesn't seem like much, that's a free 1000 HP every time you hit the damage cap while an enemy is staggered. With upcoming the upcoming bosses having millions of HP...well, you see my point by now.
I think the reason the Transformation didn't do anything, is because they are emphasizing a little bit that even if it can take some damage better, the Pulse Behemoths(sp?) are stronger than the Cocoon subjugated versions.
It's just something I kinda noticed in the game, the Sanctum's 'taming' dulls the creatures.
Can you play the ending with the music from the Japanese release? Wasn't that made by somebody different? Maybe they wouldn't place a claim?
Also, I thought the claims that were just playing the ending, I think it you comment over the song, then you are in a sense altering the soundtrack. Cause you usually talk over the music anyway.
For the ending, not sure if it would last forever, but if you put a 30 second intro of a song you know wouldn't be a problem. Youtube would flag that song but NOT the Leona Lewis ending song.... I think.
Your third idea sounds best. If you can just single out the song audio. If you can't, just mute all of the sound from the song on. You have subtitles anyway. Freaking greedy fools and their copyrights. Like anyone's going to buy the game for the song, or the CD just for that song for that matter. I'd buy it for the jazzy/blues/epic tunes this game has though.
This may sound dumb, and you've probably gotten this before, but are you going to play Final Fantasy 10 or 12? After all, you have done Let's Plays of every other Final Fantasy in the main series (except for 11 and 14, which would be impossible0)
@WingsOfWind001 Well, its the songwriter (or singer, i forget which) thats claiming copyright on the song, and its the only part of the game that belongs to her.
@Toksyuryel I'll address this, since so many people have said the same thing. Fair use only applies if you have the money to defend yourself in court, regardless of whether it is fair use or not. Even if I had the money, it wouldn't make sense for me to spend it on a copyright attorney (which are extremely expensive), and the copyright holders know this. It would be easier for me to mute that content, possibly replace it with something else, and just talk over it.
@HCBailly You are correct, however so many people do fair use companies would lose billions going in to court with everyone who does fair use, they hope we don't figure that out, over all its easier to fair use it honestly
Maybe you could use the Japanese ending which (I think) has a different song. I'm not sure if that has the same copyright or not, but it's worth looking into. If you do, maybe edit in subtitles with a video editor or use annotations. I suppose it's not a big deal, but it would be nice to have the ending in with your let's play even if it was muted.
I don't see why it bugs her so much. If anything, FF13 was the only reason i bought the song. With commentary, she should think of it as promotion.
Maybe you could find a really good cover of the song on youtube and use that. I don't know if it would still cause problems though. I'm a little fuzzy on copywrite law.
With the ending, as long as there is your commentary over it, it is technically protected by the Fair Use law. I'd upload it straight with your commentary. If she claims the copyright, counter-claim with Fair Use.
@HCBailly I would credit Leona Lewis and the publishers of the song or something in the ending video like in the intro cutscene to the game or one of the trailers so have "Song Title" by Leona Lewis, Published by ... etc.
For the ending, I think it would be a good idea to either replace the song with either a cover of the song or a different song that you believe fits well with the ending, or just mute the song.
i think in audacity you can edit music out from the voices.. its probably not that easy though. or you could just cut the audio out when they arent talking that way we can still hear them talk and you would only hear pieces of the song which im sure wouldnt cause an infringement. wouldnt be that hard to do if you just pre record the vid then comment later.
Just mute the part of the song. Seems like the most logical way. I mean, it's not really that long compared to the rest, and there are subtitles so we know what they're saying.
The ending for final fantasy xiii has been brought to you by Netflix! If posting the ending song will put your channel at risk, I would cut it out. Like you said. It's already on youtube.
As long as we get the review on the game, I don't mind the lack of an ending. It won't be as good without it, but your reviews of the LPs are too important to pass up.
I love how the animation for the anti-gravity devices are the same animation for some of Square Enix's games that have gravity spells *coughKH*cough*CC*cough
"...and jump off a cliff to perk ourselves right up." hahahahaha
Maybe Vanille didn't see cars driving so fast since Cocoon is 500 years more advanced than Pluse and Pluse is based off modern technology.
I wonder if HCBailly will use the same strategy I did (with Light, Sazh, or Hope as leader) for the upcoming boss in the next video and defeat him in around 2 minutes...
My idea for the ending song, HC, is to mute it like you said, or somehow find a way to throw in the Japanese version. I think listening to the Japanese version would be pretty cool. But chances are you wouldn't have to worry about a copyright strike and if so heck it'd only be on a single video.
This sounds stupid for me to say, but what you are describing isn't exactly OCD. OCD has to do mainly with feelings of contamination, intrusive thoughts, and a desire to satisfy compulsions to reduce anxiety, such as repetetive handwashing or taping your foot a certain number of times.
You sound more like Obsessive Compulsive Personality Disorder, which is actually a bit different and is an obsession with perfection and organization. Sorry about the lesson; I'm just OCPD like that ;)
As it's been said before, you could switch out the audio for that part with a track of your choice. I think that'd be pretty neat. Or just mute it entirely, if you don't care for the trouble.
I think I can speak for everyone saying we all want to see the ending :-)
Make sure you put in that the song is copyrighted and owned by Leona Lewis, and that you are using it under fair use and not making a profit off of it in the video description, and you should be fine.
HCBailly: For the ending video, you could always claim free use... That's what I did when I attempted to upload Mass Effect 2 videos. You aren't making money off these videos. You've never claimed to own the content. I honestly would not worry about it.
Legally speaking (at least going by what little I know of copyright law), they shouldn't be able to touch you so long as your video falls under Fair Use (which LPs do). Odds are you shouldn't have to do anything and could easily get away with just posting the video. If anyone DOES claim copyright, you are allowed to contest the claim and in theory since you're in the right, you should be able to come out on top.
@theauthorman123 Except LPs do not fall under fair use. Now you're right that odds are he could simply just get away with it but fair use only covers "partial" copyrighted content. Regarding LPs, LPs more often than not cover the entire game and in what HCBailliy is talking about is the entire song. So for both instances, the developers (or whomever covers copyright for SquareEnix) can always argue that this is the entire game, "fair use" would mean squat. Same for the ending's song.
@TheTigersAreHere Well, like I said, I'm no expert in Fair Use. If that IS the case, then I'd go with what pretty much everyone else is saying and head off to Blip.
I'm fairly sure Square either doesn't know or doesn't care, considering that they've yet to complain about HCBailly uploading their games in their entirety. If they did know and care, they'd have already started pestering him long ago, so there's (probably) little to worry about on that front, at least.
@theauthorman123 Yeah, I agree that SE probably wouldn't/doesn't care less about LPing. Leona Lewis (or her representitives on the other hand might since it is her song in question) I would say he just takes his chances and uploads the video here but solely up to him. Chances are since he's a youtube partner if he does get a claim he could easily get it erased.
Nice Woolsey-ism in the video description..yeah, Vanille's random accent shifts have been bugging me throughout this LP..it's not a big annoyance, but it's definitely noticeable.
I'm glad HC isn't all that concerned about copyright claims..I've observed Little Kuriboh get pummeled by them repeatedly..and then there's what happened this week on Facebook to Ars Technica..(their Facebook page was taken down due to a false copyright claim..some users lose their pages for good because of this.)
HCBailly the policy of fair use lets you use the song as long as it is stated within the policy of fair use and NO profit is involved at least thats what ive read
If a singer has a problem with their song being used in a game and that game is being LP'd or something, then they shouldn't have agreed to lend their

How bout you do something with the sound? like slow it down a bit in some places or do some lame remix lol
nixlegio 10 months ago
you could just use a cover, or put in your own music thast might work well, that or mute the song
zukiezuke 10 months ago
mute that part of the song and replace it with the original japanese song please?

something I noticed about the lionheart..
the descripion for it says "used by a I'cie" would that mean they are suggesting Squall was a I'cie?
Fistmaster049 10 months ago
For the ending, I think it would be a good idea to either replace the song with either a cover of the song or a different song that you believe fits well with the ending, or just mute the song.
Abscissa2 10 months ago
i think in audacity you can edit music out from the voices.. its probably not that easy though. or you could just cut the audio out when they arent talking that way we can still hear them talk and you would only hear pieces of the song which im sure wouldnt cause an infringement. wouldnt be that hard to do if you just pre record the vid then comment later.
bingostar826 10 months ago
@2:27 Vanille, you're such a wafer.
And about the ending, just cut out the song and play the 'YouTube 1911' music :P
SilentWeaponsIII 10 months ago
If the ending is in the credits, then cut it out.
If it's playing during a cutscene, be sure to have subtitles on.
If it's playing during a gameplay section, just mute the game volume.

@pornace it comes from the ceiths later on in the game.. i remember farming them a TON!

I think only Feral behemoths recover when they transform. Not the militerized ones. If you know what I mean.
silvertigrex 10 months ago
Just mute the part of the song. Seems like the most logical way. I mean, it's not really that long compared to the rest, and there are subtitles so we know what they're saying.
mightyshockwave 10 months ago
The ending for final fantasy xiii has been brought to you by Netflix! If posting the ending song will put your channel at risk, I would cut it out. Like you said. It's already on youtube.

Can you disable the in-game music? with options or something? (And use the japanese theme instead)
Freezye 10 months ago
As long as we get the review on the game, I don't mind the lack of an ending. It won't be as good without it, but your reviews of the LPs are too important to pass up.

I love how the animation for the anti-gravity devices are the same animation for some of Square Enix's games that have gravity spells *coughKH*cough*CC*cough

Just mute the song, its horrible anyway :) Use like ending theme of FF4 or something.

Is the title an Assassin Creed refence? I wouldnt think so knowing HC.

I think the 3rd idea you had is a good one HCB. Maybe you can play another song to replace the part you'll mute.

HCBailly, just use a custom ending song... I'm sure you'll come up with a more "proper" one. ;)

Sorry about the lesson; I'm just OCPD like that ;)
PsychoKrazyTime 10 months ago
I recommend that you mute the song so you can comment about the game etc.
good episode HCBailly. :)
Lindaru 10 months ago
As it's been said before, you could switch out the audio for that part with a track of your choice. I think that'd be pretty neat. Or just mute it entirely, if you don't care for the trouble.
I think I can speak for everyone saying we all want to see the ending :-)
CacheTaFace 10 months ago
i would just mute the song from the end and keep the commintary (SPELLING!!!)
boomthehedaghog4421 10 months ago
Make sure you put in that the song is copyrighted and owned by Leona Lewis, and that you are using it under fair use and not making a profit off of it in the video description, and you should be fine.
bajeezus1234 10 months ago
HCBailly: For the ending video, you could always claim free use... That's what I did when I attempted to upload Mass Effect 2 videos. You aren't making money off these videos. You've never claimed to own the content. I honestly would not worry about it.
kalennighteyes 10 months ago
You didn't post what your setup was. :\
kingkrown24 10 months ago
@kingkrown24 Most likely the same as the previous video. Check that out :)
kalennighteyes 10 months ago
can you just dub over the music with your own choice of music?
slymily 10 months ago
Legally speaking (at least going by what little I know of copyright law), they shouldn't be able to touch you so long as your video falls under Fair Use (which LPs do). Odds are you shouldn't have to do anything and could easily get away with just posting the video. If anyone DOES claim copyright, you are allowed to contest the claim and in theory since you're in the right, you should be able to come out on top.
theauthorman123 10 months ago
@theauthorman123 Except LPs do not fall under fair use. Now you're right that odds are he could simply just get away with it but fair use only covers "partial" copyrighted content. Regarding LPs, LPs more often than not cover the entire game and in what HCBailliy is talking about is the entire song. So for both instances, the developers (or whomever covers copyright for SquareEnix) can always argue that this is the entire game, "fair use" would mean squat. Same for the ending's song.
TheTigersAreHere 10 months ago
@TheTigersAreHere Well, like I said, I'm no expert in Fair Use. If that IS the case, then I'd go with what pretty much everyone else is saying and head off to Blip.
I'm fairly sure Square either doesn't know or doesn't care, considering that they've yet to complain about HCBailly uploading their games in their entirety. If they did know and care, they'd have already started pestering him long ago, so there's (probably) little to worry about on that front, at least.
theauthorman123 10 months ago
@theauthorman123 Yeah, I agree that SE probably wouldn't/doesn't care less about LPing. Leona Lewis (or her representitives on the other hand might since it is her song in question) I would say he just takes his chances and uploads the video here but solely up to him. Chances are since he's a youtube partner if he does get a claim he could easily get it erased.
TheTigersAreHere 10 months ago
@TheTigersAreHere I wish I could give your comment more than one thumbs up. More people need to read it.

upload the video to blip.tv
ComradeLuigi9956 10 months ago
Nice Woolsey-ism in the video description..yeah, Vanille's random accent shifts have been bugging me throughout this LP..it's not a big annoyance, but it's definitely noticeable.
I'm glad HC isn't all that concerned about copyright claims..I've observed Little Kuriboh get pummeled by them repeatedly..and then there's what happened this week on Facebook to Ars Technica..(their Facebook page was taken down due to a false copyright claim..some users lose their pages for good because of this.)
blackswan707 10 months ago
HCBailly the policy of fair use lets you use the song as long as it is stated within the policy of fair use and NO profit is involved at least thats what ive read

Is there an instrumental version of the song? I know most instrumental versions aren't actually licensed by companies, so maybe give that a go?
lecmg 10 months ago
If a singer has a problem with their song being used in a game and that game is being LP'd or something, then they shouldn't have agreed to lend their
