而淞滬潰退主因是日軍金山衛登陸，當時軍方真的沒防備此一日軍側翼登陸嗎？ 據楊天石先生數年前關於淞滬會戰的考證文章，有下列一段文字： -----8月20日，蔣介石得報，金山衛有日本水兵登陸偵察，指令“嚴防”。10月18日，軍事委員會第一部作戰組的情報提出，日軍有在杭州灣登陸企圖，但估計登陸部隊最多一個師，不會對上海戰局有什麼影響。 11月5日，日軍第10軍司令官柳川平助以三個半師團的兵力，在艦炮掩護下，於杭州灣北岸的金山衛登陸。------
當時軍事委員會第一部作戰組組長：劉斐
應該是這則奇怪的情報，導致淞滬戰場國軍被金山衛十萬登陸日軍背後包抄而導致潰敗。 如果不是這則情報評估，國軍應該不至於慘敗過快。
因為 1 關於日軍杭州灣登陸，其實前有戴笠沿杭州灣沿岸調查勘測，評估金山衛登陸可能性最大，並將嚴防之建議提交給蔣知曉。
2 直至10月22日第三戰區司令顧祝同將軍曾反映：聞敵將有3個師團來滬增援，其先頭部隊有(26)日可抵滬。 可惜似乎向何應欽反映卻未傳達至委員長處。

However, any other unjustifiable killings by Japanese troops are regarded as punishable war crimes during the battles against the Chinese Army, and these should be processed under the international humanitarian law. On the other hand, in case of Germany, they were not fighting the war against the Jewish people.

Those killings were, indeed, the 'crimes against humanity', and those crimes are fundamentally different from the 'war crimes' which the Japanese troops were said to have committed.

1937年盧溝橋事變爆發後，華北支那軍隊和日軍發生全面交火。7月29日在北平附近，駐守通州（今通州區）的通州保安隊對該地的日軍守備隊和特務機關發動攻擊，通州保安隊搗毀了日軍機關，俘虜了殷汝耕（通州保安隊撤退時殷汝耕逃走）。在此次事件，通州保安隊更對居留當地的日本僑民進行襲擊，大量的日本無辜僑民（多數是老弱婦孺）被搶劫、強姦、凌辱和殺戮。根據遠東國際軍事法庭的證言，中國士兵殺害至少約235個日本僑民、顧問、官兵和日韓浪人，受害者多為日本平民。

The numbers of casualties may be told differently but the fact is PEOPLE were killed and raped.
