I have a copy of the Constitution with me too as a blue booklet and I took the Tenth Amendment and put it up here and the description in the parenthesis was put in the booklet to clarify the Amendment further. So I am not adding my opinion at all, I am quoting what is in the booklet. I got the booklet from a class I took at my local community college called American National Government.
@doughnutser256 Well the parenthesis are NOT in the Constitution. They are someones opinion of what it says. Mine is from an International Politics/Relations class and is from the National Constitution Center. I trust them more than your college. Regardless, it under just the 10th amendment marijuana HAS to be legal in California and the other states that legalized it for medicinal use. How are they shutting down dispensaries in California if Feds can't trump state law?
@AnAverageSkeptic Oh okay you have a point based upon what you explained. Thanks for the explanation! I would say the first part before the parenthesis was correct though and was the same description you gave me. I accidentally forgot to put an end quote after the sentence. I know the parenthesis were not part of the original Constitution but as you said their opinion or how they see it as.
Umm... I don't agree with your view on weapons. If the average citizen cannot have an automatic weapon then who can? You do know the purpose of citizens having weapons right?
because back when the second amendment was written the british where knocking on our door- its an outdated mendment that has no relevance to today, we HAVE a police force we HAVE a national guard we HAVE a military/air force/navy we dont need a half educated drunk mutherfucker to take a AK47 and (wether accidently or drunkenly on-purpose) killing his family or shitload of people
You're welcome to your opinion but you happen to be ill informed. I'd be happy if you were correct but that just isn't backed by the evidence. I don't really want to be shot by automatic fire but I support the human right to defend yourselves ^_^
You're welcome to your opinion that there is no difference between an AK47 and a musket. I happen to think that is absurd. I'm not scared that a tyrant will seize power by force in this country. That is why we have a military. I guess it just takes a certain kind of paranoia.
So who exactly would be keeping the military in check? Who exactly would be making sure that you could retain your rights? The purpose of the right to bear arms is so that if the government and military turn on the people the people can protect themselves.
It isn't opinion. It is an analysis of facts.
Its a check to keep people from abusing power. The threat of a tyrant isn't from the outside.
That's the downfall of the Constitution, it is like the bible and anyone can twist it to be whatever they want.
Good luck fighting our military off. We do have a thing called checks and balances to help retain our rights. I think that is much more effective than a bunch of paranoid people with assault rifles trying to fight the US military.
Your analysis is opinion. Sorry to break it to you.
I never rely on opinion. I'm simply stating the reason that the 2nd amendment was created and why it is still viable. If humans want to kill each other you aren't very difficult to break. A knife will kill somebody just as easily as a gun. The problem isn't the weapon it is the monkey holding the weapon ^_^
@AnAverageSkeptic The Defense of Marriage Act. Do you know that law is unconstitutional? It violates the Tenth Amendment of the Bill of Rights. The Tenth Amendment clearly states and I quote "The powers not delegated to the United States by the Constitution, nor prohibited by it to the states, are reserved to the states respectively, or to the people. (Powers such as education, marriage, divorce). As for Education, we have the Department of Education but most Americans like the system.
@doughnutser256 I have a Constitution here and that's not what it says, you added your opinion of what it means. What it clearly States and I quote from the Constitution, "The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people."
No marriage, divorce or education.
By that marijuana HAS to be legal in the states that allow it. No Feds
Go try somewhere else, maybe they won't know what it says.

Exactly!

Enlighten me. Did we have fully automatic weapons at the time of the 2nd amendment or did they have muskets?
AnAverageSkeptic 2 years ago
The type of weapon is irrelevant. The purpose is to keep a tyrant from seizing power by force.
PinkProgram 2 years ago
It's far from irrelevant. The 2nd amendment is out of date. Get over it.
