there really isn't one defining moment and it's pretty complicated. He only worked for Cobra so he could find out who killed his Uncle and framed him for it (it was Zartan, who was trying to kill Snake-eyes under orders from Cobra Commander). He left Cobra and sometime later joined the Joes. Then he got brainwashed by Cobra towards the end of the Marvel run, and was with them throughout most of the first half of the Devil's Due run, then he joined the Joes again in the America's Elite series.

Did you know the live action movie is coming out. In the summer of 2009. Mark Wallberg. Jason Stathom and Ray Park will play Snakeyes. And there will be another Transfomrer 2 movie coming out in the same year with G.I. Joe. I think they are trying to compete!

He didn't, this whole brainwashed Duke thing is just for the the toy commercials. Scarlett however did go undercover and pretend to join Cobra shortly before the issues with Megatron, but went back to GI Joe at the end of that arc, which was around the time of these commercials.
