The order, which appeared briefly Friday in federal court documents, grants a motion to vacate Maddens 2005 conviction . Assistant U.S. Attorney John Klassen, lead prosecutor in the case, said Junells office told him the ruling was posted in error Friday on PACER, the governments electronic filing system, and that the judge was still considering his decision.

Either Judge Junell actually put his pen to paper on this ruling, or else there exists a computer that forged it there.

Maddens brief has been filed on her motion to vacate. Even though limited to just a few narrow issues I think it is very strong. Her attorneys did not put in what I think is one of the most glaring problems the citizens face. That is the fact that the US Attorney in Midland did not want the police officers in Odessa to make any type of record of their "interviews" with suspects. We have an internal OPD document that shows US Attorney "conspiring" with OPD to deny fifth amendment rights.

The recordings can help impeach kops that decide to not tell the truth. In Federal court then it is an advantage to the kops, because they can "compose" their on version of a suspects "confession". "Confessions" do not have to be recorded as they do by Texas state law. Then it is kops word agaisnt the defendant. The altered documents by Travland that was withheld from the defence in this case were so important.

i find it sad that the only system to keep our government in check prior to citizen action (investigative journalism, news, etc) extent of investigative journalism is investigating a reality show. makes me wonder how the hell big news companies got so big. lets turn on a news channel and hear what someone said on twitter.

Sampson also questioned why the name of the officer who delivered Phillips to jail was whited out on both original and duplicate copies.

Travland said he likely blotched out a name in the office before Phillips was transferred because he was no longer going to be the transporting officer. He replaced the name with that of the late OPD Cpl. Arlie Jones.

Does OPD have procedures for transporting officers? Why would Travland sign another officers name?

It's a bit of a double edged sword for me as I know it'll all come out of tax money and not these officers paycheck, but I hope once she gets out she sues.

The only way that she can sue, is if all of the charges are dismissed. Then she has to file a complain with internal affairs, then file a complaint with the state ombudsman. After all of that is decided, she then has to file a complaint with the city, after that is decided she can file in district court.

Ms. Madden has a civil suit against officer's and city already. It has been postponed so many times it is unreal. To date the officers involved in this matter have yet to do their depositions.

When Ms. Madden filed a complaint with internal affairs she was followed by one of the officers and pulled over. A little more intimadation from Commander at OPD. Proof and witnesses to back this up.

Judges can be just as crooked as cops which stems from the corruption of our government. I took Tires Plus to small claims court for Sabotaging my car during a repair and the Judge wouldn't use my papers I had from other mechanics as viable evidence, nor did he care for my video footage I had either. In regard to this video, I hope Yolanda gets out of that government cage as she does not belong in it!
