@PHAEDRIDER No where in the Rule of the Road does the phrase "powerboats must yeild right of way to sailboats" or "steam gives way to sail" Yes there is a rule about responsibilities between vessels however in this situation Rule 9 over rules and states that "A vessel of less than 20 metres in length or a sailing vessel shall not impede the passage of a vessel which can safely navigate only within a narrow channel or fairway".
100% yachts fault - In the Solent vessels over 150m have an exclusion zone of 1000m in front and 100m to the sides. That is on top of the collision regs that state a vessel constrained by draught or ability to manoeuvre has right of way. Too many idiots think that power gives way to sail in all situations - this is not the case. I have taken part in many races in the Solent and the level of seamanship is often inversely proportional to the arrogance of the skipper!
And racing sailors often don't understand normal rules of the road, even between sailboats. And almost no sailor seems to understand that an theonus is on the *overtaking* vessel, regardless of power. In other words a tornado cat or some sport boat doing 20 knots and overtaking a 235 foot John Bannenberg superyacht doing 14kt must give way. You cannot simply "come down" on the powerboat from a quartering position. Nor can you cross the bow of a ship, as in this case....
Surely you mean that the yacht was 100% at fault for this incident. Also the yacht collided with the tanker and not the tanker with the yacht. unless I am mistaken the COLREGS would prevail. The yacht should have taken action to avoid a collision. The tanker would have not been able to do so! Would it not have been within the shipping lane anyway so would have been stand-on vessel? The tanker also gave appropriate sound warning signals
The tanker was within the precautionary area and was 100% at fault for this incident. I really feel for the crew of the tanker who had no chance in the incident. Just another example of the poor standards of seamanship in many yacht skippers in the solent.
