they cant.. rockband doesnt own the rights to have a drum set.. and if that was the case guitar hero could have filed a lawsuit against rockband for putting a guitar in the game...

They did just pull ideas from other games in the world to create one full band game I agree with you, however they were the first to do it you cant deny them that. Also they did not realy invent the drums, there are already a lot of games that use drums, mostly in japan. Also I think GHWT will be better then RB2 for me, however others will definitely disagree.
