No B of A doesnt give people the run around on purpose, the bank wants to give you a loan mod, they dont want the borrower in FCL. Sometimes though people dont qualify for a loan mod and sometimes with what sounds like your case they are trying there hardest to get it done which is why you are having a issue. If you did qualify believe me they will get to you and rectify the situation. Trust me you as the costumer of B of A are highly respected, so much that there are changes coming to help more
the ultimate protection is to prove the fact that the bank does not even have possession of the deed and note.And as far as the note.They need to show the original wet ink contract and not a copy of it.And they cant show it due to it being securitized.So that will stop foreclosure and dont file bankruptcy or do a loan modifications at all.A loan mod, will set you into more trouble then its worth.miss one payment and it will tast track you into foreclosure.
@texasheat75227 I went through a 11 month trial period. Then BofA finalized it. Cool!! Now they are reneaging a 14 months later. I quit makin payment. Screw em! I'm stayin long as I can, then I'm fillin the shower, toilet, sink drains full of slurry concrete then pullin the drains. From the house clear to the sewer will be solid concrete. That's just for starters. That screwed with the wrong man
UPDATE! BOA denied modification due to my being current on my loan! Took well over one year to hear that!. Applied for a refi with BOA and got that done and closed in about ONE MONTH!! OBVIOUSLY BOA had the resources to take care of refinances in a timely manner. I guess they don't want to do modifications.
@jonathanrlowe Sue them!! It is not a requirement for you to be late on your mortgage in order to qualify. They don't want to do loan modifications because they won't make money. Foreclosures make them money. It is all a scam. Bank of America will string you along and then deny you for one of the many scripted reasons: 1) Documents were not received, 2) Documents not submitted on time, 3) Finances do not qualify, etc. etc. etc. They have about 8-10 generic responses for denying you a loan mod.
Same thing happened to me.If I called for update they would connect me to a different person who would ask why did you decide to do this and when are you going to make a payment? I have never yet missed a payment. I went on ss and had a reduced income,so I thought I would try to get my mortgage lowered according to their 31% debt ratio crap! I called yesterday and demanded that they take me off the list! I'm going to call HUD directly and see if they can help.Screw BOA!!!!!!!!

Got a Fed Ex letter from the Thursday Aug 5 saying they have received my paperwork and they will give me their decision in 30 days. Let's see how many months these 30 days take. I will actually be very surprised to hear from them

Today is 6/4/10 I paid 5 months of trial payments before my modification. Got my letter from B of A ,and they said sorry to inform you, we cannot do your remodification. What do you do at this point? Help
If you are dealing with this you should hire an attorney. When we call we get forigners reading scripts. Lawyers can deal directly with the banks loss mitigation or HAMP department. If you must, get a name and extension and go after the same person. Make them know your name call often regarding your status. The person I deal with knows me by voice. Document everything.

I am experiencing the same problem with BOA. They told me my loan was being modified and they would send me the paper work. I never received any paper work from them. The only thing they sent me was foreclosure letters.
I have been sending them payments every month for the amount of the loan modification but I still continue to receive foreclosure letters. At this point I don't know what to do.
I am going through the same thing. Told on Nov 18th that I would rcv a loan mod package in the mail by Thanksgiving 2009. Then by Christmas, then by 2010 then the excuse was that I was now in review and I needed to wait 30 days, then 45 days and then 60 business days which ended on Feb 10, 2010. They are full of sh-t and I am pursuing to start a class action lawsuit here in FLORIDA if it has not happened already.
