  • I guess what I ultimately want to ask you freedom fighters is, If the police have no right to stop...well according to you guys...anyone or ask for I.D., then how are traffic stops at all legal? If an offficer asks for license registration and proof of insurance is illegal, why does it happen all over the U.S. on a dialy basis? I don't know the answers so please respond with facts. Don't tell me cause the government is corrupt, give me a real answer.

    The Supreme Court, in the cases known as "Terry" and "Hiibel", has recognized that officers almost always need the be investigating criminal activity before they can stop and question someone (Terry), or require that he identify himself (Hiibel).

    Please read these two cases for a better understanding of our right to go about our days without having to prove that we are not violating the law on demand.

  • @Pafoofnik1 See we live in a representative democracy, and the massive epidemic of drunk driving related deaths and accidents of the 70s and 80s led people to demand something be done about it. Those representatives we elected came up with the DUI checkpoint system. It was challenged as unconstitutional, it went to the supreme court and was deemed NOT unconstitutional. How can you use one supreme court case to further your point and dismiss another that completely destroys it?

    FELONY as defined in Blacks Law #8 = serious crime. Crime being the operative word, and is defined as causing injury and/or harm. The state would be burdened with proving corpus delicti. Also one must understand that while in the public, one does not have an expectation of privacy.

    Man-made law is only applicable to and by the consent of the governed.

Funny thing is I went through one of these in broad day light and he was waving us on as he does so in this video and then abruptly stopped me as i was passing him. i at the time had no clue why or what was going on but apparently i was car #5... Sad thing is they tried and tried to nail me with something and after numerous failures they let me go but not before giving me a 150 dollar seatbelt ticket all cause i was car #5

  • @cg257: No worries. I don't agree with any type of general checkpoint because it goes against the concept of 'innocent until proven guilty'. However, I also understand that the Supreme Court agrees with me... except for DUI (and certain border area) checkpoints.

    So I disagree with them, but realize that they are currently considered to be constitutional.

But I guess what I am considering is the slippery slope that this creates thats all. This power is unconstitutional, it may be noble in it's intent but intent is often lost and warped by people over time. I didn't do you tube reasearch, I just know that not everybody that drives drunk gets killed or kills someone, your comment was a little misleading.

  • @Kmagnus80 Thank you for your condolence. Again this is all personal interpretation of the law. The U.S. Supreme Court has ruled this type of checkpoint constitutional. This is why I say its constitutional. Before you enter a checkpoint there is a sign saying there is a check point ahead. If you do not want to enter the checkpoint you are given an opportunity to turn off the road. If you decide you want to go through the checkpoint you are consenting to a brief personal seizure. 

  • @cg257 Oh that is very interesting, not that i still think it's 100 percent OK but that makes it a lot better. I was under the impression that if a police were to see that they would assume you were being evasive, kinda like if someone were to run from the cops, even if the cops had a legal reason or not they would be consdiered that probable cause. Even if it weren't probable cause, all it take is for a single light out or whatever they want to say and that is there probable cause.

  • @Kmagnus80 Yes you are correct that the police can still pull you over even if you decide to pull off the road and take the detour but like you said they need probable cause to do so. According to the SC ruling they cannot pull you over just because you did not want to commit to the checkpoint. They need PC like burnt out tail light or what have you. They call this a pretextual stop were they pull you over with PC but investigate another possible crime. Again constitutional (Whren v U.S)

These stops are sneaky though whats stopping police from setting one up where a U-turn or another detour is inaccesible, then you are stuck which i think is wrong.

  • @Kmagnus80 If there was no accessible detour available then the checkpoint would be deemed unconstitutional. A few things MUST (according to the SC) be present in order for a DUI checkpoint to be constitutional. First, police must inform drivers within a reasonable distance from the checkpoint that a checkpoint is setup and you will have to stop. Secondly, police must allow a detour from the checkpoint. If you decide to go to the checkpoint you have given consent for a brief seizure.

  • i disagree with DUI checkpoints for the mere fact that they are an inconvenience, but there is no "constitutionality" involved. state governments have the right to enforce and ensure public safety, DUI checkpoints being one of these measures. I'm assuming they do it "randomly," or in this case, every fifth car, so that they cannot be accused of discrimination. however, although they can ask for liscence since you are driving a vehicle, one can refuse a search. they are bullshit though.

    This is an untrue statement. Driving is a right. We as a nation have decided that driving on certain public roads require the possession of a license indicating proficiency in controlling the listed vehicle.

    Possession of this license is a right, once the holder demonstrates the abilities listed on the license. The license cannot be rescinded without just cause.

What I should of said: when you do get that drivers liscense it's a HUGE responsibility that you consent too (control a operating veichle safely). Now cause of the "irresponsible" drivers, we have to go thru this. But statics show that chekpnts reduce fatalities on the holidays. This is the very first time I seen a checkpnt that allowed 4 of 5 cars to pass unchecked. For at least a second they usually hand out literature and detect.

The police need a reason to pull you over on the road, but can stop you for no reason at a “CHECK POINT”? I live in the SF bay area and have never been through one and hope I never do. But if I do, I’m going to ask if they have probable cause to stop me. “HALT! DO YOUZ HAZ VE’YOUR PAP’AZ”?

  • It's totally legal and they do in fact pull over vehicles that might have been let go if they see any suspicious activity. They ask for your license, and legally if you are driving a vehicle you must present it. Nothing unconstitutional/illegal about it. If you don't have one you have in fact broken the law and are suspect to search. If there are signs of alcoholic beverages via sight/smell then they have probable cause to check. Nothing hard to understand about this.

  • @alijw The 5th car didn't get searched unless the driver didn't have a license or there seemed to be under the influence. Both of which are crimes and legally gives them the right to search you. If you present a legal license/aren't under the influence you are free to go, it usually doesn't take more then 10 seconds after handing the officer your ID. Why you would want unlicensed/drunk drives on the road is puzzling to me.

  • @gunzrkewl - the trouble is that, while DUI checkpoints are no longer challenged as "unwarranted search or seisure" it is purely because the citizens tolerate it. If the citizenry feels that a no warrant search of your home is going to keep them safe (e.g. from terrorism) then such searches will be tolerated as well (and therefore no longer challenged constitutionally). Are you comfortable with that possibility? Are there other rights you are willing to relinquish to be safe?

  • The reason they only pull the 5th car is because they have to. The limits placed on checkpoints state that there must be a pattern to avoid profiling...that means every car must be checked or every third or fifth. I don't like the idea of checkpoints but that is the reason for it.

  • @jon1151 WHAT?! I had to google that for myself. DUI 0.08% or higher, DWAI which is .05 to .07. Amazing. .05 is One-half of one-onethousands of a percent. That is an incredibly miniscule amount of acohol. They say the fines and penalties are just has "hefty" as a dui. So basically, Colorado DOES have a DUI level of .05. Driving while TIRED or FATIGUED is a far more common and greater problem than DUI is. But will they have checkpoints for that? Nope. Will they enforce immigration? Nope. Tyrants

  • Your an idiot. Asking to see an ID has nothing to do with your search and seizure rights. as stated by JCanada92227 you are required to present you ID at any time while operating a motor vehicle. It dose not infringe on any of your rights.

  • @swat3050 Incorrect, the federal courts have ruled the the interior of your vehicle and its contents are private property. Also you do NOT need to present ID to an officer unless you are being detained in relation to a crime. While we're at it, you do NOT need a drivers license to travel. This has been proven over and over in federal court. You obviously dont know your rights and how they are defined according to the law.

  • You are required by law to present a valid drivers license at ANY TIME while operating a motor vehicle. Period.

    These traffic stops are posted in the newspaper and locations are available if you call the local law enforcement office. You are not forced through the checkpoint. COMPLETELY CONSTITUTIONAL.

  • @JCanada92227 wrong, they do NOT post DUI check points ahead of time. Wrong again no drivers license is needed unless you are engaging in commerce. "avoiding a check point" by turning around gives them "probable cause" to stop the vehicle. These road blocks are commonly set up where U turns are illegal on the road. If you think these are not already being fought in court your sadly mistaken and need to do some homework.

  • How is this in any way unconstitutional? You are aware that these people have been warned beforehand and they have other ways to get to where they need to be. They aren't forced to go through the checkpoint. So in essence they have given consent by driving down that particular road. It's their fault if they don't read up on things going on in town.
