If headphones are illegal, then(as an example) car radios should fall into the same category. I hope you realize that car radios can be just as loud as having headphones in. The California State Vehicle Code describes anything with wheels (motorized or not) that operates on public right of ways as a vehicle, and as such, the vehicle's operator must follow all the same rules as an average car driver would. You can get ticketed for talking on a cell phone on a bike, just like you can get a DUI on a bike...it's the same thing as in a car.

I agree, kenny, this was a good report. It's hard enough to drive a car with a cell phone to ones ear. I know that it has to be doublily(sp?) hard to ride a bike with a cell phone stuck to ones ear. Jeez! (lol)
To add onto what I stated is that hands-free devices do not necessarily make drivers safer. In fact, they may create a false sense of security.

In most states a bike has to follow the same traffic laws as cars.
