Die Todesurteile sind für mich nachvollziehbar und wären ohne zweifel auch in jedem anderen land vollstreckt worden für eine solche tat. aber wie freisler sich benimmt ist einfach nur unwürdig für einen richter.
I'll never understand their passiveness ... Firstly, they should've questioned the legitimacy of the very proceedings and of that court as well. Secondly, they should have taken advantage of the trial and turn it into a political soapbox ... Thirdly, they should have defended the very reasons of why they wanted Dolfie dead ... Fourthly, I'm appalled to see how easily Freisler could intimidate them ... If I were in those trials, they would have to muffle me ... I would not go down so quietly ...
The trial was not public (the audience was a setup), and they were doomed. There was not much room for a political soapbox. Besides, they did not know there were cameras, and had to believe that no one would ever know what they said.
After having been tortured for several days, I think you would have looked pretty much like these guys.
Dear fredhubner, I recommend you to visit a dictatureship for a while and ask for human rights - maybe then you will understand ...
"questioned the legimacy of the very proceedings ..." ????? Are you serious`??? in Nazi-Germany??? Tens of thousands were condemned to death by such courts, some of them only for listening to foreign broadcast or telling a joke.
And OF COURSE Freisler and his henchmen prepared this trial. The accused were tortured severely, prevented from sleeping and drugged.
Living in a dictatorship is no excuse for exempting anyone from doing whatever possible to struggle against any given dictatorship ... otherwise, Chile would still be under the influence of Pinochet, Argentina would still be under Videla, South Korea would still be a military dictatorship, Spain would still be a fascist dictatorship, Portugal would still be under Salazar and South Africa would still be under apartheid ... don't you think ?!!!!
That takes time. The Third Reich remained 12 years, of which six years were time of war, in which almost all young men were at the fronts and so under control, women had to care for their families. Opposition was psychologically difficult for many, because it meant loosing the war and so in a way treachery, and surrendering to a cruel enemy, the Stalinist Soviet Union. Furthermore Nazi Germany was extremely oppressive, especially during the war.
I lived for a while in South Korea in 1990, when it still was a dictatureship. But it was possible for the students to demonstrate on the campus, without being arrested, tortured, executed. In Nazi Germany this was unthinkable. And so the Nazis, because of their successes, had many supporters, ready to turn in opponents. Opponents had to be very cautious.
@Gruenkreuz100 Germany is no longer at war, even formally, since 1990. South Korea and North Korea on the other hand are still at war - actual fighting still takes place in the border areas from time to time.
They did not know what would happen to their families and were worried about them (the wifes and children of some of them were captured in concentration camps)
"political soapbox"???
The accused did not know that they were filmed. They thought, that they spoke only to a courtroom full of Nazis.
Their composure is absolutely admirable under all these circumstances.
That's exactly the point of a soapbox ... and although you might find it hard to believe, soapboxes were invented long before movie cameras ... by a few centuries, if I'm not mistaken ... and so was the political use of them ... Furthermore, I stated what I would do under the given circunstances of the People's Court ... then again, I most certainly would be opposing Nazi rule since day one ... and probably dead long before 1944 ... like many others ...
Freisler was yelling hysterically, every time a accused said something, he did not like, so not letting them go on talking.
But he had some difficulties with Josef Wirmer (left wing lawyer and opponent right from the beginning).
One example (not in this video):
Wirmer: "When I hang, I'll have no fear, but you will!" Freisler retorted that Wirmer would soon be going to hell. Wirmer: "It will be a pleasure for me when you come soon afterwards, Mr. President!"
You're probably right ... but I believe they acted in such manner because they knew that, in various ways, they were no better than the ones judging them ... coming to think of it, when I see all those brasses there watching those 'proceedings' ... it's hard not believing that those then being judged had not been audience for such proceedings when others, who had truly resisted nazi rule since day one, were prosecuted ... that's why they behaved in such a sheepishly manner ...
Okay ... so now you're trying to convince me that all of those who we see under prosecution in that film were all "like Wirmer or Schwanenfeld". In reality, the smashing majority were not "like Wirmer or Schwanenfeld" ... in fact, nazi rule benefited Germans accordingly to their loyalty towards a criminal regime ... including those who plotted against Dolfie ... You seem overanxious in finding some good in Nazi-Germany ... at least a few pious souls ... but the ones that there were, were too few
There was nothing good in Nazi Germany, but there were some very brave people, more than many know. Travel to Berlin, there is a museum for the German resistance with many documents, or read a serious book about this topic. Then we can go on discussing.
My dear sir, you must've gotten used to debate the intricacies of WW2 with these video and Wikipedia younger generations. Every grain of knowledge I have about WW2 has been achieved the hard way by reading hundreds of books and studying hard ... It's good to know that Germans have a Museum for those who fought Nazi-Germany, but you have to reckon that one Langston Hughes does not make America less racist then what it has been and still is in a large measure: a few do not redeem the majority ...
for any non-German speakers interested in an English version: I added English subtitles to these Freisler videos a while ago. Go to overstream . net and type the word verrater in the search bar.

Ich habe vor allen sehr großen Respekt. Dennoch muss jeder wissen was er macht.
'I uncommonly regret that I could not take the place of my cousin Stauffenberg, who was prevented by his disabilities sustained in combat from completing the deed...'
-Caser Von Hofacker before the People's Court, August 30, 1944.
It is understandable that high treason carries a death sentence with it. It did in every state in those days. But the way in which the proceedings were carried out is typical of national socialism. Without dignity and the word "murder" firmly in the mind.

They wanted to show their contempt. Yelling would be beneath them. By yelling they would sink down to the level of Freisler.
Its also about a special mentalility and dignity. Many of them were raised not to show emotions and to behave disciplined.
