Publishers and companies certainly do get money from rentals and systems like Gamefly. how do you think Gamefly got the games they rent out? When people buy their games they have to buy new ones from the Companies.

If I buy my copy of Skyrim used from you rather than new from Bethesda, that's sixty dollars they will never get, and two players who recieved total twice the entertainment value for the same cost. The problem also gets worse when one game trading company does business with another. If a game was stolen and then pawned it may be difficult to impossible to play the same game without a new purchase. We may need a more direct method. Some way that certifies you purchased from a middle man the game.
the gamefly thing is stupid. gamefly purchased those copies. so yes the developer got something out of it.

It is just a company protecting themselves from liability. I doubt BioWare actually believes he/she is 12 but if he/she was, then they could face huge problems for not banning him. Bioware did the right thing. If he is 12 then the Term of use, says this game is for noone under the age of 13. Then you cant play. When your 17 trying to by beer its just not gonna let you, because it has set rules...What else would you expect?

Force, you dont have to buy MS points in stores :P You can buy MS points with a credit card aswell on Xbox Live, and some purchases such as games can be bought with money, but I agree, its unnecessary.
Yup, imo the extra currency is just ridiculous indeed, but I guess it would be good if there was there as a secondary currency, I mean for steam games for instance, you should be able to buy for real money in the steam store, but outside the store you can buy points or "cash cards" to be redeemed on steam. Same with Xbox I would think.
That would be much better, than to have a complete currency everywhere on Xbox Live.

If the information gets out that Bioware allows possible minors to create an account, after posting an age restriction, Bioware is then held legally responsible! as far a the xbox points, it can do one thing. act as a buffer so that if, say, someone hacked xbox live and tried to steal credit card number all they would get is xbox live card number. Which would be mostly used anyways. Like ps3 network, expect a hack job once they get phased out.
@SoulCharter I don't agree with console game codes either but I think just as disgusting is the used game market. I remember when Game Stop first opened in my town, the company itself was fairly young and you could go in and find incredible deals on used games. Now as the idea of used game stores has gotten more popular the companies have gotten more greedy. Now they are marking used games as new and charging near if not full price.
Well Force, the thing is: as a consumer I dont have to look at it from a business perspective. Not saying that they are screwing me over, but if a corporation is trying to screw me over it wont get my money, no matter how much sense it might make for them to do that. What you are doing is apologising in their place. Online passes suck, no matter how you look at it. But it only matters when it affects you.
although this might raise some prices slightly, it would make things simpler for the average gamer and makes everyone generally happy. if the developer of the game added into the copyright "if resold or rented, this % of money made goes to us."
In order to combat piracy, I actually do think the online passes are a step in the right direction. But the convenience of services like GameFly are too alluring to pass up so I think developers should work with them instead of against. Maybe work out a deal that for ever game they rent out, they get royalty payments. As for online, they should have a rent online pass option. New games have a code for perma use while renters pay X amount for Y duration.
It is through an admission of fact... even if it may have been a joke. I think Bioware would be criticized if they allowed someone who was under aged to continue to play.
I'm not sure what the legal ramifications would be but it must be scary enough to force their hand like that.

@CuriousMoth When I read statute they word it to try and only get one meaning. Case law defines the grey areas (which help define the nature of the statute).
I don't know the full story but in light of no other evidence to suggest the boy is not 13 what can they do? If he now says he's not 13 how can Bioware find him credible after what just happened because of his initial disclosure?
There is 'spirit' or 'nature' of the statute but from my experience it's not THAT flexible...

1. MSP should stay simply because you can already use a credit card to purchase things strait from your xbox and all that getting rid of MSP will do would be make it so that you cant gift someone a MSP card and people who dont have a creditcard on their account cant buy DLC's without them

businesses like gamefly and gamestop should pay the developers a small amount for each rental or used game purchase. That way you could both play online with a rental and the developers would get more money to spend on making their games better.
Overall from the consumer perspective, you might get a small increase in price but you'll get a better service and quality game.

The games you rent at gamefly have been bought by gamefly so that would be stupid, same stuff for used games, when you sell your game at Gamestop, it's gamestop's money, not publishers' money. So the developpers are just being greedy as f*ck. Console gamers will have to get used to it, it's been like this for ages on PC.

as far a the xbox points, it can do one thing. act as a buffer so that if, say, someone hacked xbox live and tried to steal credit card number all they would get is xbox live card number. Which would be mostly used anyways. Like ps3 network, expect a hack job once they get phased out.

@SoulCharter I don't agree with console game codes either but I think just as disgusting is the used game market. I remember when Game Stop first opened in my town, the company itself was fairly young and you could go in and find incredible deals on used games. Now as the idea of used game stores has gotten more popular the companies have gotten more greedy. Now they are marking used games as new and charging near if not full price.

Well Force, the thing is: as a consumer I dont have to look at it from a business perspective. Not saying that they are screwing me over, but if a corporation is trying to screw me over it wont get my money, no matter how much sense it might make for them to do that. What you are doing is apologising in their place. Online passes suck, no matter how you look at it. But it only matters when it affects you.

although this might raise some prices slightly, it would make things simpler for the average gamer and makes everyone generally happy. if the developer of the game added into the copyright "if resold or rented, this % of money made goes to us."

In order to combat piracy, I actually do think the online passes are a step in the right direction. But the convenience of services like GameFly are too alluring to pass up so I think developers should work with them instead of against. Maybe work out a deal that for ever game they rent out, they get royalty payments. As for online, they should have a rent online pass option. New games have a code for perma use while renters pay X amount for Y duration.

It is through an admission of fact... even if it may have been a joke. I think Bioware would be criticized if they allowed someone who was under aged to continue to play.
I'm not sure what the legal ramifications would be but it must be scary enough to force their hand like that.
From what I've learned through my job. People can be people but the law is a robot, if you can understand that?

@CuriousMoth When I read statute they word it to try and only get one meaning. Case law defines the grey areas (which help define the nature of the statute).
I don't know the full story but in light of no other evidence to suggest the boy is not 13 what can they do? If he now says he's not 13 how can Bioware find him credible after what just happened because of his initial disclosure?
There is 'spirit' or 'nature' of the statute but from my experience it's not THAT flexible...

This really isn't some law based thing, this is just some troll forum admin getting a hard on whenever they get a chance to ban someone. A rational human being would ask a simple question, while an utter cunt would ban first and not even bother to ask questions at all, the latter being what Bioware's staff did.

1. MSP should stay simply because you can already use a credit card to purchase things strait from your xbox and all that getting rid of MSP will do would be make it so that you cant gift someone a MSP card and people who dont have a creditcard on their account cant buy DLC's without them
2. If they continue with there "Need a code to play online" it should say that on the cover of the game no Puts game in console>Goes to play multiplayer>Gets hit by truck>Need code>waisted $10-$60 its unfair.

businesses like gamefly and gamestop should pay the developers a small amount for each rental or used game purchase. That way you could both play online with a rental and the developers would get more money to spend on making their games better.
Overall from the consumer perspective, you might get a small increase in price but you'll get a better service and quality game.

The games you rent at gamefly have been bought by gamefly so that would be stupid, same stuff for used games, when you sell your game at Gamestop, it's gamestop's money, not publishers' money. So the developpers are just being greedy as f*ck. Console gamers will have to get used to it, it's been like this for ages on PC.
