We must end this false belief. the Colorado punks are all being taught its ok to tax Marijuana. (Double PUKE)

  • Half the times I was arrested, the officer (once we were at the jail) had to LOOK UP THE LAW in a book to know what to book me for! Now, THAT should signify a HUGE problem...

  • I think, Ridley, what this man is trying to say - is that regardless of what one person feels about one law or another - we can't have police officers making the individual decision to outright swear to NOT enforce particular laws. Jardis should have kept his mouth shut - and just used skillful discretion - instead of blatantly saying he wouldn't enforce law, since that is his job to do. This will, no doubt be dissected nine ways to Sunday - but I think you get my drift.

  • I thought his argument, as you reported it, for refusing to arrest people for drug offenses was a bit tenuous. If the wording of the constitution made prohibition of narcotics clearly illegal I would have a different attitude.

    It might have been better had he said that he would use his discretion not to enforce anti-drug statutes. Thus he could, (perhaps under protest) follow direct orders on a case by case basis.

    I'm not against prohibition, but am for obeying the law, (i.e. constitution).

    The tenth amendment says if the constitution doesn't clearly give the feds the power they aren't allowed to do it.

    Your argument is the exact opposite of what the founding fathers meant the constitution to do, clearly define what the feds can do and prevent them from doing anything else.

    I don't disagree with your basic position.

    However, it was the NH constitution that was quoted in the Ridley Report where the policeman's argument for refusing to arrest people on narcotic charges was given. My comment did not refer solely to the US constitution, but principally to the NH constitution upon which the policeman in question was largely grounding his position.

    NH was a free nation at the US foundation & remains free to prescribe or permit within NH law, doesn't it?

    I believe the U.S. Constitution does not stop states from passing laws to control substances.

    I don't know what the NH Constitution says , I spend too much time trying to learn about the national constitution to start on a state one.

    However if a constitution does forbid the state from doing something any laws passed that do that thing do not actually have the force of law.

    Damn, I'm starting to talk like a lawyer.

  • When the laws are unethical, breaking them is ethical.

    There are far more than 100,000 pages of laws. It's impossible to enforce them all. & impossible to follow them all. The result of a coercive monopoly passing laws without weighing the cost & benefits to those forced to pay for them, has resulted in a system out of control. Too complex for a person to make any rational sense of it. With mercenaries ordered to violate laws all the time. By passing countless laws we've achieved chaos.

  • He IS enforcing the law...just not all of the statutes and acts and CORPORATE POLICIES (many of which ARE unlawful) Therefore... He IS upholding his oath to uphold the law. Cole's actions hopefully will have the effect of publicly bringing this to light... hopefully that is to shine a big light on the difference between 'legal' and 'lawful'.
