  • 107. Limitations on exclusive rights: Fair use

Notwithstanding the provisions of sections 106 and 106A, the fair use of a copyrighted work, including such use by reproduction in copies or phonorecords or by any other means specified by that section, for purposes such as criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship, or research, is not an infringement of copyright.

    TAKE THAT COPYRIGHT NAZI TROLLS

    HA!!

  • youtube is run by a bunch of nazi's.. none of this content should be block as long as you are not making a profit from it and you clearly give credit to the owner of the copyrighted material... because it falls under the fair use law.. its the same reason why college kids can right essays and quote or use ideas from other works and not get sued for it.. all i got to say is fuck youtube and its nazi ass parent compay google.. there both CIA fronts anyways... pieces of shit..

  • We need to hire a squad of ninja assassin mercenaries and hunt their sorry asses down.

  • It's like old George Carlin said, You are property of the corporations, and there's nothing you can do.

  • @danjuno You have no choice, you have owners. They own YOU.

They have owned us for a good long time, so this isn't something new.

  • @tbone2004 LOL oh George we all miss ya xD

  • I get annoyed whenever I or someone else makes a parody video and it gets removed because parody falls under the fair use doctrine. The Supreme Court of the United States stated that parody "is the use of some elements of a prior author's composition to create a new one that, at least in part, comments on that author's works." That commentary function provides some justification for use of the older work. YouTube apparently doesn't recognise the ruling of the Supreme Court.

  • Actually, what we need to do is to make our YouTube.

  • I just fell victim to copyright Nazis again. I used a song which is in Japanese, just used it and gave it English subtitles so people who don't know Japanese can understand what's going on.

The thing that pisses me off the most is how strict the copyright rules are here, but they won't do shit when it comes to spammers and trolls.

If there's anything we can do about copyright Nazis, I'll join the war against them.

  • I know the copyright nazis are a problem. What pisses me off the most is that they remove audio in many videos.

  • @MidnightPsychoKiller then just leave the same song on other videos right? anyone else notice that cause they havent noticed the others...

  • they not there lol

  • i agree, this is ridiculous, i thought it was fair game if you gave proper credit to what you were using. i mean then what's the point to writing a paper or something where you gather information from other sources, hello mcfly. there are just scared shitless bc they don't want a lawsuit from some douchebag recording artist or something like how metallica back in the day shut down napster. well are they gonna knock on my door when i make a cd from one i bought!?! so dumb.

  • They blocked biggie's "mo money mo poblems" because of copyright issues. I swear if youtube keeps this bullshit up, they will parish.

  • youtube is not awesome they muted olivia munn because they blocked her intro music thats fucking blasphemy!!! fuck youtube

  • It is arbitrary! MOST (technically all) OF THE VIDEOS ARE USING SOME COPYRIGHTED MATERIAL!!! However, they appear to be "fair use" of that material. So, all the "enforcement," appears to be, illegal.

People used to argue, ATM machines should be outlawed because they put bank tellers out of work. Here they seem to be arguing: FAIR USE should be ignored and replaced with NO USE, because the internet has made some old media industries, less profitable than they used to be.

  • There were a group of people led by Ned Ludd who destroyed industrial machinery because they thought that the machines would put the workers out of a job. But today, instead of a lawless group of vandals, we have anti-free speech FASCISTS who mute videos and have the power of the (however wrong) laws backing them with guns and tazers. It's a sad commentary on a government when you fear the police force more than the criminals.

  • i respect your point but at the same time law enforcement and corrections does protect our community and lives not all of them are fascists...;P

  • Whatever you call them, they seem like bullies.

  • I totally agree. And it's not just music, even PRESIDENTIAL SPEECHES are being zapped by the Copyright Nazis; it isn't even a copyright issue! This is about history! And music as well as speeches are a part of history. I can totally understand clamping down on say, posting new music videos and such but if they're more than ten years old, I say they're fair game for posting. Who's with me?

  • Viacom, Warner and Universal are like the Axis Powers.

  • omfg so annoying

  • agreed 100% i have so many good old vids were ppl didn't mention the disclaimer and when i go back to watch them they are all blocked!
